Identification application NIP-7

You are not entered into CEIDG, but you run a business? Maybe you are a VAT payer or you would like to hire a nanny on the basis of an activation contract? In this case, you should submit an identification application using the NIP-7 form. You will use the same form (as an update application) to inform the office about the change of data. See below how you can do it.

What you should know and who can benefit from the service

You will receive your NIP tax ID on the basis of an identification application. You submit such an application only once. Remember that you can only have one NIP. Therefore, the type of taxes you pay or the number or type of business you do does not matter.

For whom the NIP-7

Apply for a NIP on NIP-7 form if you are a taxable person who is not subject to a CEIDG registration but:

  • you conduct business activity (e.g. as a partner in a registered or professional partnership), or
  • you are subject to registration as a VAT payer (e.g. a farmer subject to VAT), or
  • you are a registered VAT payer.

Apply also if you do not have your own company, but:

  • you do not have a PESEL number,
  • you are a tax payer (e.g. you employ a babysitter or housekeeper),
  • you are a payer for social and health insurance (e.g. you employ an employee as a lump sum farmer).

The head of the tax office will give you a Tax Identification Number (NIP) using the Central Entity Register - National Taxpayer Register (CRP-KEP).

Update of data on NIP-7 form

Submit NIP-7 if you want to update your data (e.g. name, address, bank account number or ID card). You have 7 days to do this from the day on which the changes occurred.

When should you handle the matter

Remember, if you are:

  • a taxpayer of value added tax or excise tax - submit an application before the performance of the first activity related to your economic activity. If you are a natural person, submit a NIP-7 identification application only if you register as a VAT payer (the NIP-7 identification application is submitted independently of the VAT-R registration application);
  • a taxpayer other than VAT or a payer - submit an application no later than within the time limit provided for filing the first application, return, information or statement, or together with making the first payment of the tax or advance payment of the tax.

Remember, if you are:

  1. You will receive a confirmation that you have been assigned NIP

If the office decides that your application is correct, you will receive a NIP confirmation.

The Office may refuse to give you confirmation if it finds that:

  • you cannot confirm your identity or existence,
  • your application does not meet the requirements,
  • you already have a NIP,
  • you are in the PESEL register and do not run a business or you are not a registered VAT taxpayer.

The Office will give you a NIP within 3 days of receiving a correctly filled identification application.

How can you appeal

If you do not agree with the decision of the office to refuse the NIP, you have the right to appeal against it. An appeal must be lodged with the Director of the Revenue Administration Chamber which has jurisdiction over the office that issues the decision in your case. You have 14 days from receiving the decision to do this.

In your appeal, describe what you do not agree with and give reasons for it.

It is good to know

PKD codes

Remember to provide the PKD code for the prevailing activity in your application. You can check the PKD codes in the PKD code search engine.

Keep the office well informed

Please note that it is your responsibility to report updates. If you do not comply, you will be fined for a fiscal offence. This refers to cases where you do not report the change of data on time or provide incomplete or untrue data.

Cancellation or repeal of the NIP

The Office may revoke your NIP of its own motion if it is found that:

  • you have more than one number,
  • you have a number issued based on false or fictitious information.

The Office may revoke your NIP if it is found that you have a false or fictitious address of the place of business. If you enter the correct data, the office will restore your NIP.
