Laboratory diagnostician - provision of cross-border services in Poland

Are you a foreigner - a citizen of the EU, Norway, Iceland, Switzerland or Liechtenstein - and would you like to temporarily provide cross-border services in Poland as a laboratory diagnostician? You must first submit a declaration that you intend to provide a cross-border service and, in some cases, also obtain recognition of your qualifications. You will find out how to do this below.

What you should know and who can use this service

Applicant - Polish citizen or a citizen of other than the Republic of Poland Member State of the European Union, Member State of the European Free Trade Association (EFTA) - parties to the Agreement on the European Economic Area and entrepreneurs conducting business activity in a country, party to an agreement with the European Union and its Member States regulating the freedom of provision of services, who exercise the profession of laboratory diagnostician in one of the above mentioned States, in accordance with provisions of that State, are authorized to provide services in the territory of another Member State (in this case the Republic of Poland) in the field of the same profession.

What to do step by step

  1. Submitting a declaration on the intention of providing cross-border services in the territory of the Republic of Poland

Before the provision of cross-border services for the first time in the territory of the Republic of Poland, the service provider submits a declaration to the National Council of Laboratory Diagnosticians on the intention of provision of a particular cross-border service. The declaration contains information on the insurance policy held or other means of personal or collective insurance related to the exercise of the profession of a laboratory diagnostician, applicable in the territory of the Republic of Poland.

The service provider may submit the declaration to competent authority in person, by another person, by post or by means of electronic communication.

In addition, in the case of the provision of services for the first time in the territory of the Republic of Poland and in case of a significant change in the situation substantiated by the documents, the National Council of Laboratory Diagnosticians requires that declaration shall be accompanied by the following documents (on the basis of Article 33 (4) and (5) point 4 of the Act of 22 December 2015 on the principles governing the recognition of professional qualifications acquired in Member States of the European Union):

  • a document confirming citizenship of the service provider;
  • a certificate confirming that the service provider is legally exercising a particular profession and that he is not subject to a prohibition (even temporary) to exercise the profession;
  • documents confirming professional qualifications;
  • a document confirming the exercise of a particular regulated profession by the service provider for at least one year in the period of the previous ten years or completion of regulated education - in case of profession which is not regulated n the applicant's country;
  •  a certificate of lack of criminal record, if it is required from Polish citizens who intend to exercise a regulated profession connected with public security, health care or education of juvenile including child care and early education;
  • a declaration confirming command of Polish language necessary to exercise a regulated profession - in case of professions having patients' safety implications.

Conditions for service provision:

Cross border service in a regulated profession may be provided by a service provider who holds professional qualifications for exercise of a particular profession in a State of service provider if the profession:

1) is regulated in the State of the service provider, or

2) is not regulated in the State of the service provider, and the service provider

a)  has exercised this profession in the Member State for at least 1 year during the last 10 years, or

b) completed regulated education

Time limit

Before commencing the provision of services for the first time in the territory of the Republic of Poland, and again in every year in which the service provider intends to provide cross-border service.

  1. Formal and substantive verification of the submitted documents

The National Council of Laboratory Diagnosticians shall immediately notify the service provider of the receipt of the statement and documents, if required.

If any deficiencies are found in the statement or in the documents attached thereto, the National Council for Laboratory Diagnostics shall call upon the service provider to complete them within 7 days of the date of receipt of the request, provided that the unfilled statement cannot be used to provide cross-border services.

The request for submission of documents indicated by the authority should be made on the basis of Article 33(4) or (5) of the Act of 22 December 2015 on the rules for the recognition of professional qualifications acquired in the Member States of the European Union. If the applicant completes the documents incompletely or the documents submitted contain imprecise provisions, the National Council for Laboratory Diagnosticians shall again call for their completion or clarification.

The National Council for Laboratory Diagnosticians may request the competent authorities of a Member State to provide information confirming that the laboratory diagnostician is carrying out his activities in a lawful and proper manner and that no disciplinary or criminal sanctions are imposed on him in connection with the exercise of his profession.

If the declaration of intent to provide cross-border services and the documents submitted were complete or improved, the KRDL assesses them. It is assessed:

  • subject of the service provided,
  • the duration of the service,
  • frequency of services provided in Poland,
  • regularity of service provision,
  • continuity of services provided.

In case of a properly submitted set of documents and a positive substantive verification, the applicant may commence cross border services in the territory of the Republic of Poland in the field of the profession of a laboratory diagnostician.

  1. Issuing a decision on recognition of qualifications or a decision on withdrawal from verification of professional qualifications of the service provider

In case of the profession of laboratory diagnostician, the National Council of Laboratory Diagnosticians, when necessary, may initiate proceedings on recognition of qualifications, if the service provider intends to provide a particular service in the territory of the Republic of Poland for the first time. The National Council of Laboratory Diagnosticians, within one month from the date of receiving the declaration together with the attached documents, issues a decision on recognition of qualifications or issues a decision on withdrawal from verification of professional qualifications of the service provider. In case the issuance of a decision on recognition of the qualifications of the service provider or decision on withdrawal from the verification of qualifications is not possible within one month from the date of receipt of the declaration, the National Council of Laboratory Diagnosticians shall inform the service provider in that term on reasons for the delay and on the expected term of issuing the decision. The decision is issued not later than within two months from the date of receiving the documents by the National Council of Laboratory Diagnosticians, mentioned in Article 33 (4) of the Act of December 22, 2015 on Principles of Recognition of Professional Qualifications Acquired in the Member States of the European Union.   

Lack of decision made by the National Council of Laboratory Diagnosticians within the terms described above means, that the service provider may commence provision of cross border services in the territory of the Republic of Poland.

In case a decision on the need for carrying out a verification procedure for the purpose of recognition of qualifications has been made and there are significant differences between professional qualifications of the service provider and training or education required in the Republic of Poland, which have impact on public safety or health, and knowledge, skills or competences acquired by professional experience or by confirmed learning outcomes or confirmed education outcomes cannot offset them, the National Council of Laboratory Diagnosticians allows the service provider to take an aptitude test.

The  National Council of Laboratory Diagnosticians obliges the sevice provider to take an aptitude test and within one month from imposing this obligation issues a decision on recognition of qualifications.

The National Council of Laboratory Diagnosticians, within 3 days from the date of receiving the declaration, forwards to the Director of the Center for Examinations in Medicine the following information:

1) the list of persons, who shall attend the aptitude exam in the indicated term within a particular regulated medical activity;

2) information on the differences in the training program;

3) the training program in the regulated medical profession applicable in the Republic of Poland.

The aptitude test is developed by the Center for Examinations in Medicine individually for each person examined and is conducted by the State Examination Committee within 3 weeks from the date of submitting the declaration.

Aptitude test - process:

The Director of the Center for Examinations in Medicine informs the examinee on the fee amount and provides the bank account number of the Center for Examinations in Medicine to which the fee should be paid. In case of persons intending to provide cross border services, the fee is paid within 3 days from the date of receiving the notification. The aptitude test is carried out within 3 weeks from the date of submitting the declaration. The aptitude test consists of a theoretical exam or a practical exam, or a theoretical and practical exam. The theoretical exam is carried out in oral form or in the form of a test. The form of the aptitude test is decided upon by the Director of the Center for Examinations in Medicine after consulting the Chairman of the Committee. The Director of the Center for Examinations in Medicine informs the examinee on the place and form of the aptitude test at least 3 days before the designated date of the aptitude test.

If the theoretical part of the exam is carried out in the form of a test, it consists of at least 20 and not more than 50 questions.  The test is considered completed and passed when the examinee obtains at least 60% of the maximum number of available points.

In case of conducting the theoretical exam in oral form, it includes at least four examination questions. Each answer is evaluated separately by each member of the Committee or the examination team. The answer may be evaluated negatively if such evaluation is determined by at least half of the members of the Committee or the examination team. Obtaining a negative evaluation of any of the answers provided by the examinee results in failing the oral examination.

The practical part of the aptitude test consists of at least four tasks involving demonstration of chosen operations relevant for a laboratory diagnostician or performing other tasks confirming possession of practical skills necessary to perform the profession of laboratory diagnostician in the Republic of Poland.

The aptitude test shall be considered submitted with a positive result if the examinee obtains positive evaluation of each part constituting the aptitude test.

The applicant, who has submitted an aptitude test with a positive result, is issued a certificate by the Director of the Center for Examinations in Medicine, a copy of which is passed to the National Council of Laboratory Diagnosticians. The certificate is issued within 3 days from the date of receiving the complete examination documentation.

A protocol is drawn up from the conducted aptitude test which includes a description of the performed tasks constituting the scope of the practical exam, and the results of the aptitude test. A copy of the conducted aptitude test is forwarded to the National Council of Laboratory Diagnosticians by the Examination Committee within 3 days from the date of finding the results.

In case of failure of submitting the aptitude test in the indicated term or submitting the test with a negative result, the National Council of Laboratory Diagnosticians, on the basis of a written application, issues a decision on the admission to take an aptitude test within the nearest prescribed term, which becomes the final term.

The result of the aptitude test is the basis of recognition by the National Council of Laboratory Diagnosticians whether the indicated differences have been eliminated by the applicant.

In case of a negative result of the aptitude test, the National Council of Laboratory Diagnosticians refuses to recognize professional qualifications of the applicant by means of decision. A negative decision on recognition of qualifications results in the lack of authorization to provide cross border services by the applicant. The applicant has the right to appeal the decision.

Documents

Time limit

Within one month from the date of receipt of the declaration.  Where a decision on recognition of the qualification of the service provider or the decision on withdrawal from recognition is not possible within one month from the date of receipt of the declaration, the National Council of Laboratory Diagnosticians informs the service provider before the expiry of that deadline, about the reasons for the delay and then removes them within one month from the date of such communication.  The decision is issued no later than two months from the removal of the causes of delay (e.g. completing missing documents).  In the event of imposition of obligations on the service provider to take an aptitude test, the National Council of Laboratory Diagnosticians issues its decision within one month from the imposition of such obligation. 

If no decision has been taken within the deadlines referred to above, it means that service provider may start providing cross-border services in Poland.

How much you will have to pay

980 zł

Conduct of the procedure and issuance of a decision on the recognition of professional qualifications to pursue a regulated profession, shall be subject to payment of 35 % of the minimum wage, established on the basis of the Act of 10 October 2002 on the minimum remuneration for work, in force in the year of the initiation of the proceedings.  The fee shall be paid into the bank account of the National Council of Laboratory Diagnosticians.

In 2021 the minimum wage amounted to PLN 2800.

How long you will have to wait

1. Notification of receipt of the declaration shall be given without delay. 2. The decision shall be issued within one month of receipt of the declaration. Where it is not possible to issue a decision on the recognition of a provider's qualifications or a decision not to recognise qualifications within one month of receipt of the declaration, the competent authority shall inform the provider, before the expiry of that period, of the reasons for the delay and shall subsequently remove them within one month of the date of communication. The decision shall be issued no later than two months after the removal of the reasons for the delay (e.g. completion of missing documents). Where an obligation is imposed on the provider to take an aptitude test, the competent authority shall issue a decision within one month of the imposition of the obligation. 3. A lack of decision in the above mentioned terms means that the service provider may commence provision of cross-border services in the territory of the Republic of Poland.

How can you appeal

Within 14 days from the date of receiving the negative decision, the applicant has the right to submit an application for reconsideration of the matter. After consideration of that application, a decision is issued on revoking the appealed decision in full, in part, or on leaving that decision in force. In case of leaving the decision in force - the applicant may submit a complaint to the Voivodeship Administrative Court in Warsaw within 30 days from the date of receipt of the resolution, through the National Council of Laboratory Diagnosticians.

Good to know

The service provider is obliged to inform the Social Insurance Institution (ZUS) about the intention to provide a cross-border service before the beginning of the service, and in case of an emergency - after the termination of its provision (in accordance with Art. 31 (2) (4) of the Act of 22 December 2015 on the Principles of Recognition of Professional Qualifications Acquired in the Member States of the European Union). In practice, this activity consists in obtaining a certificate (on A1 form)by a service provider on social security cover from the insurer's institution in his own country. If necessary, the certificate obtained should be presented to a ZUS employee, e. g. in the course of control activities.
