Permit to locate an exit or reconstruct an exit

What you should know and who can use this service

1. A construction project may be carried out on condition of having an access to a public road. An access to a public road is obtained, among others, through an exit. An exit is a connection between a public road and a real property located at the road, constituting a place of direct access to the public road (pursuant to Article 4 (8) of the Act of 21 March 1985 on public roads). The investor (the owner or perpetual usufructuary of a real property adjacent to the road) is obliged to build or rebuild an exit after obtaining, a permit of the road operator for location or reconstruction of the exit. In should be noted that in case of a road construction or reconstruction, the road operator is responsible for the construction of new or reconstruction of the already existing exits.

2. An application for a permit to locate an exit or reconstruct an exit should be submitted to the road operator competent in view of the road category and location of the exit. In Poland, the road operators are as follows:

1) the General Directorate of National Roads and Motorways as regards national roads;

2) a voivodeship board as regards voivodeship roads;

3) a district board as regards district roads;

4) a head of the commune (mayor, president of the city) as regards commune roads.

3. Operators of voivodeship, district and commune roads may perform their duties with the help of an organizational unit which constitutes the road administration, created by the voivodeship assembly, district council or commune council. Therefore, e.g. in case of voivodeship roads, tasks of the road management may be performed by the relevant voivodeship road administration.

1. An application for a permit to locate an exit or reconstruct an exit should be submitted to the road operator competent in view of the road category and location of the exit. In Poland, the road operators are as follows:

1) the General Directorate of National Roads and Motorways as regards national roads;

2) a VOIVODESHIP BOARD as regards voivodeship roads;

3) a district board as regards district roads;

4) a head of the commune (mayor, president of the city) as regards commune roads.

Therefore, the investor must first determine who the operator of the road is. Just to be on the safe side, it is worth contacting the appropriate office.

 

2. Tasks within the scope of the management of national roads are also carried out by relevant branches (which are divided into divisions) of the General Directorate for National Roads and Motorways. The competent branch to which an application for a permit to locate an exit from a national road should be submitted can be found on websites of the GDDKiA (in the branches tab). It is worth knowing that the General Director for National Roads and Motorways performs tasks related to issuing permits to locate an exit also in case of motorways handed over for management to relevant companies contracted to construct and operate or only to operate a motorway.

 

3. An application concerning voivodeship roads is submitted to the competent marshal's office (as an auxiliary unit of the voivodeship board). If there has been established the relevant administration of voivodeship roads that performs tasks of the road operator, the application should be submitted to such administration.

 

4. An application concerning district roads is submitted to the competent district governor's office (as an auxiliary unit of the district board). If there has been established the relevant administration of district roads that performs tasks of the road operator, the application should be submitted to such administration.

 

5. An application concerning commune/municipal roads is submitted to the competent commune or municipality office (as an auxiliary unit of the head of the commune, mayor or president of the city). If there has been established the relevant administration of municipal/commune roads that performs tasks of the road operator, the application should be submitted to such administration.

6. Within the limits of cities with district rights, the road operator of all public roads, with the exception of motorways and express roads, is the president of the city. Therefore, an application concerning such roads is submitted to the competent city hall (as an auxiliary unit of the president of the city). If there has been established the relevant administration of municipal roads that performs tasks of the road operator, the application should be submitted to such administration.

  1. Formal verification of the application

1. The road administrator assesses whether the application has been submitted in accordance with the territorial competency. Where the administrator to which the application has been submitted is not competent in respect of the case, it forwards the application forthwith, along with justification, to the competent roadadministrator (notification of the transfer of the application is also sent to the applicant).

2. The road administrator to which the application for issuing a decision on the permit to locate an exit has been submitted verifies the application in formal terms. If the application is not complete, the road operator requests the applicant to remove the defects within 7 days, with an instruction that a failure to remove the defects will cause that the application will be left without examination (Article 64(2) of the Administrative Procedure Code).

3. If the party has failed to pay amounts due on account of the stamp duty and costs of the proceedings, which should be paid in advance in accordance with regulations, the road operator conducting the proceedings will set a deadline for making these payments. The deadline may not be shorter than 7 and longer than 14 days. If the amounts due are not paid within the set time limit, the application is returned (Article 261(1) of the Administrative Procedure Code).

  1. Substantive assessment of the application and issuing a decision

1. The competent road operator verifies the application in substantive terms. If the application meets all the requirements arising from provision of the law, the road operator issues a decision authorizing the exit location. The permit is issued for an indefinite period of time (with the provison that the decision to issue a permit for the exit location expires if the exit is not built within 3 years from its issuance.

2. If the application does not meet the requirement arising from provision of the law, the competent road operator issues a decision on the refusal of granting the permit to locate or reconstruct the exit. Such a decision may be issued due to requirements resulting from technical conditions to be met by public roads. Alternatively, the road operator may issue a permit to locate the exit for a definite period.

3. The maintenance of exits, including culverts underneath, is the responsibility of owners or users of land adjacent to the road.

4. For the construction or reconstruction of a exit without permission of the road operator, or with parameters other than those specified in the permit, the road manager shall impose, by way of an administrative decision, a fine of 10 times the fee for seizing the roadway in order to carry out works in the road lane or to seize the road lane with exclusive rights for another purpose (according to Article 40 (4) of the Act on Public Roads). The said penalty shall also be imposed by the road operator for using the exit after the date specified in the road manager's permit. The penalty shall be paid within 14 days of the date on which the decision determining its amount became final.

5. If in connection with the construction or reconstruction of an exit, it is necessary to occupy the road lane, it is necessary to obtain a decision on allowing the road lane to be occupied.

Fee for issuing a decision - in accordance with the appendix to the Act of 16 November 2006 on stamp duty, Part III, item 44, item 2.

How long you will have to wait

Your case will be settled within one month. This period may be extended to two months, subject to notification by the official.

How can you appeal

1. The investor and parties to the proceedings may appeal against the decision concerning permission to locate the exit to the competent local government board of appeals. The appeal should be filed through the road operator which has issued the decision within 14 days from the date of receipt. This is regulated by Article 127 (1) and (2) of the Code of Administrative Procedure.

2. Decision issued by the General Director of National Roads and Motorways may not be appealed against. A party dissatisfied with the decision may submit an application for reconsideration of the case to the General Director of National Roads and Motorways through the competent branch.

Good to know

1. If your investment only involves the construction or reconstruction of an exit on the basis of a permit for the location of the exit, you do not have to additionally obtain a decision on the conditions of development and land development.
2. Once you have been granted permit to ;ocate an exit, you must:

  • agree with the road manager on the construction design of the exit - if a construction project is required,
  • report the construction or reconstruction of the exit or obtain a building permit or a reconstruction permit,
  • obtain permit from the road manager to carry out work in the road lane.

3. There are two types of exits:

  • public - determined by the road operator as an exit to at least one building in which a business activity or activities of a public nature are carried out,
  • individual - determined by the road operator as an exit to one or more buildings used individually.

A public exit should have:

1) should have:

a) a width of not less than 5.0 m, including the roadway of a width of not less than 3.5 m and not more than the width of the roadway of the road,

b) a hard surface within boundaries of the roadway,

c) an intersection of the exit surface and road surface rounded up with circular curve of a radius of not less than 5 m,

d) the longitudinal slope of the exit within the crown of the road, adjusted to its shape,

e) over a length of not less than 7.0 m from the edge of the crown of the road, the longitudinal slope of the exit of not more than 5%, and over a further length - of not more than 12%,

2) from a new road of Class GP or G to a petrol station should be fitted with additional lanes for vehicles turning from this road,

3) from a road of Class GP, G or Z to a building where where a business or public service activity is carried out, can be fitted with additional lanes for vehicles turning from this road, particularly when the reliable traffic intensity exceeds 400 P/h.

This should be justified by traffic safety considerations.

An individual exit should have:

1) a width of not less than 4.5 m, including the roadway of a width of not less than 3.0 m and not more than the width of the roadway of the road,

2) a hard surface at least within the roadway,

3) an intersection of the exit surface and road surface rounded up with a circular curve of a radius of not less than 3 m or with a slant 1 : 1, if it is an exit from a street,

4) the longitudinal slope of the exit within the crown of the road, adjusted to its shape,

5) over a length of not less than 5m from the edge of the crown of the road, the longitudinal slope of the exit of not more than 5%, and over a further length - of not more than 15%,
