What to do step by step

  1. Submitting an application for the issuance of a certificate for the recognition of veterinary surgeon qualifications in Member States of the European Union

A veterinary surgeon applying for the issuance of a certificate for the recognition of qualifications of a veterinary surgeon in the European Union Member States, submits an application to the Regional Council of Veterinary Surgeons of the Chamber he is a member of.

  1. Formal and substantive verification

1. The Regional Council of Veterinary Surgeons verifies the correctness and completeness of the application required for the proper conduct of the procedure and evaluates the level of fulfillment of requirements by the veterinary surgeon for the issuance of the certificate.

2. In case of finding formal deficiencies, the Regional Council of Veterinary Surgeons summons to supplement the application within a given term under the penalty of leaving the application without consideration. The applicant has 7 days to supplement the documents, counting from the day of receiving the summons. In case the applicant does not supplement the deficiencies in the documents within 7 days, then the application is left without consideration (Article 64 (2) of the Administrative Procedure Code).   The applicant may apply for a suspension of the proceedings if the 7 day term is insufficient to supplement the deficiencies.

3. The Regional Council of Veterinary Surgeons, before the issuance of the certificate, turns to the Regional Screener for Professional Liability / National Screener for Professional Liability and to the Regional Veterinary Court / National Veterinary Court - depending on which authority has jurisdiction to rule as the first instance, and to the register of punished veterinary surgeons maintained by the National Council of Veterinary Surgeons, whether:

  • there are pending investigations against the applicant;
  • there are any pending proceedings against the applicant on the grounds of professional liability;
  • the applicant is listed in the register of punished surgeons, maintained by the National Council of Veterinary Surgeons.

Authorities, which have been inquired and the person authorized to provide information from the register of punished veterinary surgeons, provide the Regional Council of Veterinary Surgeons with information on the applicant without undue delay, but not later than within 5 days.

  1. Issuing a certificate for the recognition of qualifications of a veterinary surgeon in Member States of the EU

The Regional Council of Veterinary Surgeons issues ex officio a certificate for the recognition of qualifications of a veterinary surgeon in Member States of the EU or refuses to issue the certificate. Refusal of the issuance of the certificate results in providing the applicant with the resolution on the refusal (for the purpose of it potential appeal to the National Council of Veterinary Surgeons).

How can you appeal

1. A refusal of issuance of an extract with the content requested by the applicant is made by means of a resolution, which may be subject of a complaint, in accordance with Article 219 of the Administrative Procedure Code. 

2. A complaint is filed within seven days from the date of delivery of the resolution to the party, and when the resolution has been announced orally - from the day of the announcement to the party; Article 141 (2). 

3. The competent authority to consider the complaint is the public administration authority of a higher level, which in this case is the National Council of Veterinary Surgeons; Article 127 (2) of the Administrative Procedure Code.
