Real property appraiser in the field of real property valuation - recognition of qualifications

What you should know and who can use this service

1. Nationals of the Member States of the European Union, the Swiss Confederation or Member States of the European Free Trade Agreement (EFTA) which is a party to the Agreement on the European Economic Area who acquired in those countries (outside the borders of the Republic of Poland), qualifications and experience to pursue the profession of real property appraiser in the field of real property valuation, may apply for recognition of professional qualifications for the pursuit of this profession in Poland.

2. In addition, for recognition of qualifications may apply::

  • family members of Polish citizens or citizens of the Member States referred to in point 1 above;
  • third-country nationals who are long-term residents of the European Union;
  • foreigners with refugee status or subsidiary protection;
  • foreigers arriving in the Republic of Poland or staying the territory for the purposes of family reunification, who are family members of a foreigner who is a resident in the territory of the Republic of Poland by virtue of having been granted refugee status or subsidiary protection;
  • third-country nationals who apply to be admitted to the territory of the Republic of Poland for the purposes of highly qualified employment;
  • third-country nationals who have been admitted to the territory of the Republic of Poland for purposes other than work in accordance with European Union provisions or national law, who are allowed to work and who hold a residence permit in accordance with Council Regulation (EC) No 1030/2002 and a third-country national admitted to the territory of Poland for the purpose of work in accordance with European Union law or national law;
  • third-country nationals holding a temporary residence permit for the purpose of carrying out scientific research

3.  In accordance with point 8 of Article 4 of the Act of 21 August 1997 on the real property management, the property valuation is understood as activities relating to the determination of the value of the property (and of machinery and equipment permanently connected with immovable property). 

4.  In addition to the relevant qualifications and experience, applicants for recognition of qualifications for the exercise of the profession of real property appraiser in the field of real property valuation should:

  • have full legal capacity;
  • not be punished for an offence against the State institutions and local authorities, for an offence against justice, for an offence against document integrity or against property, for an offence against a transaction involving money or securities, or a fiscal offence. 

5.  The applicant for the recognition of the professional qualification to pursue regulated profession should have knowledge of the Polish language necessary for practising the regulated profession in the territory of the Republic of Poland.

6.  If an applicant for recognition of qualifications is not domiciled or habitually resident in Poland or in another Member State of the European Union and he has not established an attorny-in-fact, residing in Poland and does not operate through the consul of the Republic of Poland, he is obliged to appoint an attorney-in-fact in Poland for the service of documents (except where service is effected by means of electronic communication). If no attorny-in-fact authorised to accept service is appointed, the documents addressed to this party (applicant) are left in the case file and are deemed to have been delivered.  The party must be informed at the time of the first service.  The party must also be informed of the possibility of submitting a response to the document initiating the proceedings and written explanations and on who can be appointed as an attorney-in-fact.

The appointment of an attorney-in-fact is not necessary when the letters are served by electronic means of communication.

  1. Formal verification of the application

1.  The competent authority shall verify the application in which checks whether the applicant has submitted all the documents necessary for the proper conduct of the procedure. 

2.  If the formal defects in the application are found, the competent authority shall invite the applicant to supplement them within a time limit specified in the letter, otherwise the application will not be considered.,  

3.  The authority in charge of procedures for the recognition of qualifications shall notify the applicant of the receipt of the application within one month from the day of receiving it.

  1. Substantive assessment of the application

1.  During the substantive verification, the competent authority shall verify whether the applicant’s qualifications acquired abroad are appropriate to pursue a regulated profession for which recognition is sought by the applicant in the Republic of Poland.  In duly justified cases, the competent authority shall request the Member State to confirm:

  • the absence of prohibition or suspension of the right to pursue  the profession by the person applying for recognition of professional qualifications for the profession of qualified valuer in assessing real estate;
  • the authenticity of evidence of formal professional qualifications (referred to in Article 18(2) (6) of the Act on the principles governing the recognition of professional qualifications acquired in Member States of the European Union).

2.  In case of justified doubts about the documents certifying education received, in whole or in part, in a Member State other than the one which issued it, or the completion of training received, in whole or in part, in a Member State other than the one which issued it, the competent authority can check them, in cooperation with the issuing State:

  • the education or training has been formally certified by the competent institution in the Member State in which the document was issued;
  • a document issued is the same as that which would have been issued if the completion of education or training received, in whole or in part, in the territory of the Member State where the document was issued;
  • document confers the same rights to pursue the profession in the territory of the Member State in which it was issued. 

Cooperation with Member States’ authorities is implemented via the IMI system. 

3.  The recognition of professional qualifications of the  depends first and foremost on the education and training programme, as well as the professional experience of the applicant.

4.  As a result of the documents analysis, it is concluded that the applicant:

  • holds appropriate qualifications and experience for the recognition of professional qualifications;
  • in order to obtain the decision on the recognition of qualification must complete an adaptation period or take an aptitude test. 

5.  In the latter case, the Minister shall send the order to the applicant to complete an adaptation period or to take an aptitude test.  The order lays down the programme and duration of the adaptation period, and the scope of knowledge and skills of an aptitude test for each application on the basis of the following:

1) certificates and diplomas and other documents certifying professional qualifications held by the applicant;

2) the education and training programme completed by the applicant;

3 Period of professional practice and skills acquired by the applicant in the profession;

4) the period which is necessary for acquisition of the skills required for the exercise of a regulated profession in Poland;

5) the scope of examination requirements covering knowledge and skills necessary for the exercise of a regulated profession in Poland;

6) the differences resulting from the special characteristics of a regulated profession in Poland and in the applicant's State;

7) knowledge of Polish law and professional terminology in the Polish language necessary for practising the regulated profession. 

6.  Applicant after receing he following provisions applies to the investigating authority for serving an adaptation period or conducting an aptitude test (at the discretion of the applicant).  The right to choose between an adaptation period and taking a test can be excluded in the special cases. This depends, for example, on the difference between the applicant's qualifications and the required qualifications.   Exclusion of the right of choice needs to be justified by facts and law.  For more information on the adaptation period and the aptitude test read the section: The course of an adaptation period or an aptitude test for a property appraiser.

  1. Issuing a decision

1.  In case of a positive assessment of an application and the accompanying documentation, the Minister of Investemnt and Development shall issue a decision on the recognition of professional qualifications to pursue the profession of property appraiser in the field of real property valuation.  The authority shall notify the applicant on the recognition of professional qualification. 

2.  In the case of a negative evaluation of the application a decision refusing to recognise a professional qualification is issued.  

3.  In the case of recognition of qualifications the applicant is entered in the register of real property appraisers. After obtaining a decision on the recognition of the qualification to practise as a real property appraiser in the field of real property valuation, the applicant may use the professional title "real property appraiser" as of the date of entry in the register. A person whose professional qualifications have been recognised has the right to pursue a regulated profession under the same rules as a person who obtained professional qualifications in the Republic of Poland.

Time limit

Not later than 3 months from the date of submission of the necessary documents by the applicant.  In exceptional cases, the deadline for issuing a decision may be extended by one month.  The period for the applicant, who either serves an adaptation period or takes an aptitude test, shall be suspended until the day of obtaining an assessment by the competent authority.

How much you will have to pay

980 zł

Conduct of the procedure and issuance of a decision on the recognition of professional qualifications to pursue a regulated profession, shall be subject to payment of 35 % of the minimum wage, established on the basis of the Act of 10 October 2002 on the minimum remuneration for work, applicable in the year of the initiation of the proceedings.  The fee shall be paid into the bank account of the Ministry of Investment and Development.

In 201 the minimum wage amounts to PLN 2800.

How long you will have to wait

The period for the applicant, who either serves an adaptation period or takes an aptitude test shall be suspended until the day of obtaining an assessment by the competent authority.

How can you appeal

In accordance with Article 127 of the Code of Administrative Procedure, a party which is dissatisfied with the decision may ask the Minister of Investment and Development for a reexamining of the case.  Such applications must be submitted within 14 days of receipt of the decision.  In proceedings relating to a retrial,  provisions concerning appeals against decisions are applicable.

Good to know

A person whose professional qualification to pursue a regulated profession are recognised must have knowledge of the Polish language to the extent necessary for the exercise of the profession.  Verification of knowledge of Polish language may be made after issuance of the decision on recognition of qualifications, where there is reasonable doubt regarding the sufficient knowledge of the Polish language to practise a regulated profession.  Verification of knowledge of Polish is made on the request of the person whose professional qualification to pursue a regulated profession shall be recognised.  The verification of knowledge of Polish is subject to a fee, which is determined by the unit carrying out verification
