Recognition of qualifications cations are recognized

What you should know and who can use this service

An applicant (a Polish citizen or a citizen of a Member State of the European Union other than the Republic of Poland, the Swiss Confederation or a Member State of the European Free Trade Association (EFTA) - a party to the Agreement on the European Economic Area) who applies for recognition of qualifications to practise a regulated profession in the territory of the Republic of Poland must document his qualifications to practise the regulated profession for recognition of which the person applies.

To practise the following regulated professions:

1) crane operator;

2) hoist operator;

3) crane maintenance technician;

4) hoist maintenance technician;

5) operator of lift trucks with mechanical lifting drive;

6) maintenance technician of lift trucks with mechanical lifting drive;

7) person filling portable tanks,

it is required to hold a document corresponding or equivalent to the qualification certificate referred to in Article 22(3) of the Act of 21 December 2000 on the Technical Inspection.

What to do step by step

  1. Submission of an application to initiate proceedings for recognition of qualifications to practice a regulated profession

According to Article 13(1) of the Act of 22 December 2015 on the Principles of Recognition of Professional Qualifications Acquired in the Member States of the European Union, proceedings for recognition of qualifications are initiated upon application. The application should be accompanied by documents confirming qualifications (e.g. education, professional experience), drawn up in Polish or with a copy of translation into Polish made by a sworn translator.

The applicant submits the application along with proof of payment directly to the Office of Technical Inspection in Warsaw.

Where an applicant for recognition does not have a place of residence or habitual abode or registered office in Poland or another Member State of the European Union who has not appointed, for purposes of the conduct of proceedings, an authorised representative residing in the Republic of Poland and does not operate through the consul of the Republic of Poland must appoint a proxy in Poland for the service of documents. Appointment of a proxy is not required when the service letters are delivered by means of electronic communication.

  1. Formal and substantive analysis of the submitted documents

The Office of Technical Inspection verifies the application in formal terms. In case of finding formal defects, the Office of Technical Inspection requests to remove them within specified time; otherwise the application will be left without examination. 

When carrying out the substantive verification, the Office of Technical Inspection checks what the Applicant holding qualifications obtained about is authorized to do and whether they are appropriate to practise the regulated profession for the recognition of which the applicant applies. In justified cases, the Office requests additional information from the EU Member State where the document confirming qualifications has been issued or the support centre functioning in a Member State.

After the applicant has submitted the complete documentation and after an assessment of the submitted documents, the Office of Technical Inspection establishes that:

1. The applicant has appropriate qualifications required for recognition of professional qualifications

or

2. The applicant does not have appropriate qualifications required for recognition of professional qualifications

or

3. The applicant has to serve an adaptation period or take an aptitude test for the purpose of obtaining a decision on recognition of qualifications, due to:

a) substantial differences in education or training;

b) the fact that the period of education or training completed in the applicant's country is shorter by at least one year than the period of education or training required by regulations in the host country;

c) existing differences in the scope of professional activities of this particular profession between the country from which the person comes and the host country.

In order to compensate the differences between the applicant's qualifications and the qualifications required in regulations governing the right to practice the regulated profession, the Office of Technical Inspection issues an order on the requirement to serve an adaptation period or take an aptitude test. Read the detailed description of adaptation period and aptitude test. In the order, the Office determines duration of the adaptation period and its programme, as well as a detailed scope of the aptitude test, in particular on the basis of:

1) certificates, diplomas and other documents confirming the applicant's professional qualifications;

2) the programme of education and training completed by the applicant;

3) a period of professional practice, as well as professional skills acquired by the applicant to practise the requested regulated profession;

4) the period which is required to acquire qualifications to practise the requested regulated profession in the Republic of Poland;

5) the scope of examination requirements covering skills and knowledge necessary to practise the requested regulated profession in the Republic of Poland;

6) differences resulting from the specificity of obtaining qualifications and practising the requested profession regulated in the Republic of Poland and in the country in which the applicant has obtained qualification to practise this profession;

7) the level of risk associated with hazards occurring during the performance of the requested regulated profession.

The adaptation period programme and subject scope of the test is determined for each Applicant individually, taking into account the existing differences between the applicant's qualifications and the qualifications specified in provision concerning the right to practise the regulated profession. The order may be appealed against.

  1. Issuing a decision on recognition of qualifications

A decision on recognition of qualifications is issued no later than within 4 months from the date of submission of all the necessary documents by the applicant. If the applicant serves an adaptation period or takes an aptitude test, the time limit is suspended until the Office of Technical Inspection receives an assessment of the course of the adaptation period or results of the aptitude test. The provisions of the Administrative Procedure Code apply to matters concerning issuing and delivering decisions (subject to provisions of the Act).

The Office of Technical Inspection may specify a validity period of the decision taking into consideration validity periods stipulated in the documents submitted by the applicant.

In case of a negative assessment of the submitted documents or a negative result of the aptitude test or a negative assessment of the adaptation period by its supervisor, the Office of Technical Inspection issues a decision on the refusal to recognize professional qualifications. The Applicant is entitled to file an appeal against the decision.

You willl receive the decision within 3 months from the date of submission of the necessary documents. This time limit may extend by 1 month in special cases. The official will inform you about it. If the applicant has to serve an adaptation period or take an aptitude test, the time limit is suspended until the Office of Technical Inspection receives an assessment of the course of the adaptation period or a result of the aptitude test.

How can you appeal

The appeal procedures are governed by the provisions of the Administrative Procedure Code. The applicant has 14 days to submit an application for reconsideration of the matter. After consideration of that application, a decision is issued on revoking the appealed decision in full or in part, or on upholding that decision. In case of leaving the decision in force - the applicant may submit a complaint against the decision to the Voivodeship Administrative Court in Warsaw, through the Office of Technical Inspection in Warsaw.
