How to obtain a certificate on lack of arrears in payment of contributions

An important document attesting lack of the grounds for exclusion from a procurement procedure is a certificate from the Social Security Institution (ZUS), confirming that the contractor has no arrears in payment of social security contributions, health insurance, Labour Fund, the Guaranteed Employee Benefits Fund and the Bridge Pension Fund (optional) or has obtained an exemption, deferral or payment in instalments of arrears.  This certificate must be issued not earlier than 3 months before the deadline for the submission of applications for participation in the procurement or tenders.

The ZUS certificate will be needed also in other situations, for example when applying for a loan.

A certificate of no arrears in the payment of contributions for social security, health insurance, the Labour Fund, the Guaranteed Employee Benefits Fund and the Bridge Pension Fund (optional) shall be issued at the request of the payer of the contributions by the Organizational Unit of ZUS competent for the payer's seat.

Importantly, there is no minimum limit amount of debt which would justify issuance of certificate of no arrears in the payment of contributions.  This means that even small arrears can lead to exclusion of your company from the proceedings.

The issuance of the certificate is free of charge.

Submission of the application

Form of the application for issuance of a certificate of no arrears in the payment of contributions is available at the ZUS branch.  It can also be downloaded on the PUE ZUS portal as ZUS-EWN application. Application of the payer of the contributions for issuance of a certificate of no arrears in the payment of contributions shall be submitted to the competent ZUS unit or send by registered mail to that address.  A certificate of no arrears in the payment of contributions can be collected in person or by post (in accordance with the provision laid down in the application).

A certificate of no arrears in payment of contributions and the decision refusing to issue a certificate issued by ZUS in the form of an electronic document with a qualified electronic signature may be used in printed form by the contributions payer who obtained it. This means that they have the same effect as documents issued by ZUS, if they contain data that allow their verification.

ZUS issues certificates of no arears in the payment of contributions within 7 days from the date of the receipt of the application.  If there are reasons which preclude the issuance of certificate of no arrears in payment of contributions, the Organizational Unit of ZUS shall issue a decision to refuse the issuance of certificate of no arrears in the payment of contributions.

 

Obtaing a certificate instantly

You can also obtain a certifictae instantly from the ZUS office.  You do not have to fill in paper applications, it is sufficient to tell the ZUS employee what kind of certificate you want to obtain.  The employee will ask you about the necessary details, submitting electronic application in the IT system of ZUS.  
 
After oral instruction and introduction of the necessary data into the system, the employee will print a copy of the application for signature.  The last step is receiving a certificate.
