Duties of the service provider towards the customer relating to the provision of services

Service providers wishing to provide services in Poland are required, prior to entering into a written agreement for the provision of services (and if it is not concluded - before the provision of services), to provide the customer with the following information (if they are known) in a clear form:

  • the company name, business address or home address and principal place of business;
  •  the registration authority and the registration number, in which the provider is registered as an entrepreneur or a number in the register of business activity;
  • the e-mail address or other data for direct contact with the service provider;
  • the indication of the authority that issued the certificate, license, approval, consent or made ​​an entry in the register or other document issued entitling the service provider to provide the service;
  • the indication of a professional body, to which the provider belongs, the professional title and the Member State in which the title was granted;
  • the main features of the service;
  • the price of the service, if it has been determined;
  • contract patterns used by the service provider and contractual provisions concerning the law applicable to the contract or the court or other competent authority for the settlement of disputes
  • the tax identification number (NIP) or other identification number, which the service provider is required to use for the purposes of VAT;
  • about the compulsory insurance or financial guarantee, together with the details of the insurer or guarantor and the territorial coverage of insurance;
  • about quality guarantees of the service which are not required by law.

At the request of the customer, service provider provides the following additional information:

  • about the method of calculation of the price for the service if the price is not pre-determined, or if it is impossible to give an exact price;
  • about legal regulations concerning the regulated profession performed by the service provider and means in which you can get access to them;
  • about codes of good practice, which the service provider is subject to, together with an indication of their publication;
  • in case the service provider is subject to a code of good practice or a member of a trade association or professional body which provides for recourse to dispute settlement, the service provider shall provide information in this field, as well as determine the way in which you can get access to detailed information on the characteristics and conditions of the use of alternative dispute resolutions.

The above information, a service provider is obliged to provide in such a manner that the customer has no problem with familiarizing himself with this information, in particular:

  • at the place where the service is provided;
  • at the place, where the contract concluded;
  • on its website;
  • in information documents supplied to the customer.

It should be emphasized that the service provider temporarily offering or providing the service in Poland may be either a natural person from another Member State, who does not operate business activities, and an entrepreneur from another Member State, as well as a natural person who is a resident in Poland, and who does not operate business activities.
