Handling environmentally burdensome substances

It is prohibited to introduce or re-use substances having a particular threat to the environment, except as provided in the Act on environmental protection and other regulations.

Substances presenting a particular risk to the environment are, in particular:

1) asbestos;

2) PCBs (polychlorinated biphenyls, polychlorinated terphenyls, monomethylotetrachlorodiphenylomethane, monomethylodichlorodiphenylomethane, monomethylodibromodiphenylomethane and mixtures containing any of these substances in quantities greater than 0.005% by weight of the total).

The above substance also include: aldrin, dieldrin, endrin, isodrin, DDT, hexachlorocyclohexane and lindane.

All of these substances should be used, handled and eliminated while retaining special precautions.

Systems or equipment, which are using or have used substances having a particular threat to the environment, should be cleaned or disposed of.

For systems or equipment for which there is reasonable suspicion that they were using these substances, the requirements for handling of these systems and equipment are identical to those, in which they are or were using these substances.

Used substances, posing a particular threat to the environment, are subject to successive elimination.

An entity using substances having a particular threat to the environment is required to document the type, number and locations of their occurrence and means of eliminating them. This entity should also periodically submit information about the type, number and locations of their occurrence to the voivodship marshal.

In relation to other substances (nonaggressive substances) one needs to remember that their introduction into the environment is permissible only insofar as it is necessary in view of the nature of the business. However, they should be packaged in a manner to prevent accidental discharge into the environment. At the same time they should be accompanied by information (leaflet) providing identification of risks, which result from the introduction of this substance into the environment.
