Water permit for water consumption

  • Water permit

A water permit for special use of water is issued for a period not longer than 20 years.

The party in the proceedings for a water permit is the applicant applying for a permit or the legal owner of the water.

The water permit indicates the purpose and scope of the use of water, conditions for the exercise of the powers and duties necessary for the protection of environmental resources, the interests of the population and the economy, in particular:


1) the amount consumed or discharged waters, including the maximum number of sq. m. per hour and the average number of sq. m. per day and the maximum number of sq. m. per year;

2) the time of consumption and discharge of water and discharge of wastewater for facilities, whose activity is characterized by seasonality;

3) the manner and scope of the measurements of quantity and quality of consumed water in its original state;

4) procedure in case of failure of measuring devices;

5) conducting periodic performance measurement and water level in the well;

A water permit is issued on a basis of an application.

The application should be accompanied by:

1) report on water and law matters

2) a description of the intended business conduct drawn up in a non-technical language.

Competent authority for issuing water permits is the district governor. However, in case the water consumption may significantly affect the environment, the competence to issue the permit is given to the marshal of the province.

  • Report on water and law matters

The report is drawn in descriptive and graphic form.

The report may be also drawn on digital data carriers as a text document with the graphic part of the report as a vector or raster file.

The descriptive part of the report contains:

 

1) the designation of the entity applying for the permit and the address of its registered office;

2) a specification of:

a) the purpose and scope of the intended use of water,

b) the type of measuring equipment and navigation signs,

c) the legal status of the property situated within the intended impact of water use or planned for the implementation of water facilities, with given seats and addresses of their owners

d) the obligations of the applicant for a permit in respect of third parties;

2a) a description of the water unit, including location using geographic coordinates and the basic parameters characterizing the device and the conditions of its implementation;

3) characteristics of the waters covered by the water permit;

3a) the characteristics of the receiver wastewater covered by the water permit;

4) The findings arising from the water management plan for the basin and the conditions of water use in the water region;

5) indication of the effect of water management of the facility on surface waters and ground waters, in particular on the status of these waters and the implementation of the environmental objectives set out for them;

6) The planned start-up period and procedure for the start-up, stopping of the activities or failure or damage to the measuring equipment and the size, conditions of the use of water and water facilities in these situations;

7) information on the forms of wildlife conservation created or established under the Act of April 16th, 2004 on the protection of wildlife, occurring within the intended impact of water use or planned implementation of water facilities.

The graphic part of the report however contains:

1) plan of water facilities and extent of the impact of intended use of water or planned construction of water facilities, together with marking the real estate and their surface applied to the situation and elevation map of the area;

2) the basic cross and longitudinal sections of the water facilities and troughs of water flowing channels in the range of impact of these devices;

3) schematic arrangement of measuring devices;

4) functional or technological diagram of water facilities.

The report, on the basis of which a water permit for water consumption is issued should also include:

1) an indication of maximum hourly, average daily and maximum yearly water consumption in square metres;

2) technical description of equipment used for water consumption;

3) indication of type of equipment used for recording and measurement of water consumption.

4) indication of the scope and frequency of required analysis of the consumed water.
