What you should know and who can benefit from the service

In order to sell a specific kind of alcohol you need a relevant license.

There are three types of permits ( depending on the volume of alcohol)

  • up to 4.5% vol. of alcohol, and beer;
  • between 4.5% vol. and 18% vol. of alcohol (except for beer);
  • over 18% vol. of alcohol.

If you want to offer in your shop all types of alcohols, submit application for three permits.

Note! Anyone who sells alcoholic beverages without the required license or contrary to the conditions is guilty of an offence which carries a penalty of a fine.

What to do step by step

  1. Submit an application for a license for the sales of alcoholic beverages

Select in the application which alcoholic beverages you intend to sell (model application form ycn be found below).  In the single application, you can apply for all possible licenses.  If you conduct a company in the form of a civil-law partnership, the application must be signed by all partners.  If  you chose one person who is to represent the whole partnership, then the application must be signed by the partner who is authorised to represent the company.

  1. Municipal office check your application

If the authority finds that the application is incomplete, you will be requested to complete documents. You will have 7 days to complete the documents from the day when you receive the request. If you do not complete missing documents within the prescribed time, you will receive a notification on leaving the application without examination or decision to return the application.

  1. The Municipal Committee for Resolving Alcohol Problems in a given office will issue an opinion

On the websites of municipal offices there are resolutions on rules for the location of points of sale and serving alcoholic beverages.  In its decision you can check at what distance from church or school it is possible to sell alcohol. The municipal committee shall evaluate whether the location of your point of sale complies with those conditions and provide its opinion — positive or negative

If you do not pay for the license, despite the receipt of the request for payment, the office will issue such an order to return an application.

If your application is correct, the location of the points of sales is appropriate and you paid for the license, the office will issue the license.  

If more applications than the limit set by the municipal council have been submitted to the authority, on the granting of the permit will decide:

  • greater distance of the planned point of sale from the nearest point of sale (this distance is calculated as the shortest way to get to the point of sale via public roads)
  • fewer sales points already operated by the applicant

License for the sale of alcoholic beverages shall be issued for:  

  • a minimum of 2 years - in retail outlets (shop, petrol station), 
  • minimum 4 years - catering establishments (restaurant, pub).  

If your application is correct in terms of form, but not on the substance, then the office issues a decision not to grant a license.

How much will you pay

The amount of fees depends on the type of alcohol sold:

1. alcoholic beverages up to 4.5% of alcohol and beer and beverages from 4.5% to 18% of alcohol (excluding beer):

  • PLN 525 - entrepreneurs starting to sell alcoholic beverages at a given point of sale (first license) and entrepreneurs who received less than PLN 37,500 in the previous year
  • 1.4% of the value of sales in the previous year - entrepreneurs who in the previous year achieved a value of sales higher than PLN 37 500 

2. alcoholic beverages exceeding 18% of alcohol:

  • PLN 2100 - entrepreneurs commencing sales of alcoholic beverages at a given point of sale (first license) and entrepreneurs who in the previous year obtained the value of sales of less than PLN 77,000
  • 2.7% of the value of sales in the previous year - entrepreneurs who in the previous year achieved a value of sales higher than PLN 77,000


When to pay

If you start the sale of alcoholic beverages, pay the fee for license to the account of the municipality, prior to granting the license.  

Where to pay

The permit fee should be paid to the account of the city or municipality you are applying to (check the account number on the website of the city or municipality).

Fee for entrepreneurs who have already sold alcoholic beverages
 

If you have already sold alcoholic beverages and you want to get a new license for subsequent years, the value of sales for the preceding financial year calculate in the gross amount (i.e. with VAT and excise duty), separately for each type of alcohol.  Pay the calculated fee to the account of the municipality in each calendar year covered by the license in three equal instalments, as follows:  by 31 January, 31 May and 30 September of the given calendar year or one-off by 31 January of the calendar year concerned.

In the year of acquisition or expiry of a license, the fee must be paid in proportion to the period of validity of the license.

Note!  You can pay in instalments ONLY where the license does not start or end in the current year. If the license expires during the calendar year in question, the payment for the use of the license pay in proportion to the period of validity of the license until 31 January.

Fee for the application submitted during the year

If you want a license during the year, the fee for the license to calculate the pro rata to the period of validity of the license.  
 
1) For licences to sell alcoholic beverages containing up to 18 % of alcohol calculate the fee as follows:  

  • PLN 525 ÷ number of days in the year x number of days until the end of the calendar year 

2) For licences to sell alcoholic beverages containing more than 18 % of alcohol calculate the fee as follows:  

  • PLN 2100 ÷ number of days in the year x number of days until the end of the calendar year 

Similarly calculate the fee if your licence expires during the course of the year.

How long will you wait

Your case will be settled within one month. This period may be extended to two months, subject to notification by the official.

It is good to know

Pay annually for the permit

Every year you must submit a declaration by 31 January on how much particular types of alcoholic beverages you sold in the previous year. On the basis of this statement, you pay an annual fee for the use of the permit.

The office will revoke your permit

If, e.g.:

  • you sell and serve alcoholic beverages to minors, intoxicated persons, on loan or deposit;
  • you do not call the police or the municipal police for troubled customers.
  • you sell alcohol from illegal sources
  • you provide false information in the statement of the annual value of sales of alcoholic beverages (e.g. if you underestimate or overestimate the value of alcohol sold)
  • you commit a crime in order to obtain financial gain
  • you have been banned from engaging in the business activities covered by the permit

If your license has been revoked, you may submit an application for re-issuing a license not earlier than after 3 years from the date a decision has been made on its revoking.

When a license expires

The license expires in case of:

1) liquidation of the point of sale;
2) the date of expiry of the license;
3) a change of the nature of the point of sale;
4) a change of the partners of a civil law partnership;
5) failure to submit a statement on the value of sales of particular types of alcoholic beverages in the previous year by January 31st or failure of bringing in the fee in amounts and deadlines indicated by the Act (in such a case you may submit an application for re-issuing the license not earlier than after 6 months from the date of the decision on the expiry of the license).

The sale of alcoholic beverages after the revocation or expiry of the permit is the same offence as if the permit had never been issued (there is a fine for this).
