Organisational and technical conditions for providing and using the services provided by Information Point the Entrepreneur (biznes.gov.pl)
I. Introduction

Information Point for the Entrepreneur, hereinafter referred to as: Point, run by the Minister of Entrepreneurship and Technology, with its registered office at Plac Trzech Krzyży 3/5, 00-507 Warsaw.

2. The point operates under addresses in the domain of biznes.gov.pl and businessinpoland.gov.pl.  

3. The point of contact shall perform the tasks of the existing Single Contact Point on the basis of

  • Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market (OJ L 376, 27.12.2006, p. 36) (the Services Directive);
  • Act of 6 March 2018 on the Central Register and Information on Economic Activity and the Entrepreneur Information Point (Journal of Laws, No. 647).

4. The point shall provide information on, inter alia

  • formalities and procedures related to starting, running and closing a business in Poland;
  • the general principles governing the provision of services in the Member States;
  • contact details and competences of selected public institutions and offices;
  • ways and conditions of accessing public registers and public databases concerning business activity and entrepreneurs;
  • the legal remedies available in the event of a dispute between a competent authority and an entrepreneur or a consumer, between an entrepreneur and a consumer and between entrepreneurs;
  • the authorities' and the Point's explanations of the rules concerning the taking-up, pursuit and termination of the activity;
  • the contact details of associations and organisations which can provide practical assistance to entrepreneurs or consumers;
  • rights and obligations of employees and employers;
  • list of regulated professions in the Republic of Poland;
  • contact details of authorities dealing with issues related to recognition of professional qualifications, provision of cross-border services and issuance of the European Professional Card for particular regulated professions and contact details of the Polish support centre for the recognition of professional qualifications;
  • a list of the professions for which a European Professional Card is issued and the rules for applying for it, including the fees to be charged for its issue;
  • list of regulated professions and regulated activities related to public health or safety, referred to in the provisions issued on the basis of Article 34(8) of the Act of 22 December 2015 on the rules for recognition of professional qualifications acquired in the Member States of the European Union (Journal of Laws of 2016, item 65, and of 2018, item 650);
  • a list of types of regulated education and training and of courses with a special structure;
  • procedures for the recognition of professional qualifications, including fees payable and the documents required;
  • rules on the provision of cross-border services;
  • the requirement to have the knowledge of the Polish language necessary to pursue a regulated profession or activity;
  • appeals against the decisions issued in the cases described above.

5. The point shall provide the following services:

a) ensuring that procedures and formalities can be completed:

  • undertaking, carrying out and terminating business activity on the territory of the Republic of Poland;
  • the recognition of professional qualifications acquired in the Member States of the European Union, with the exception of an adaptation period and an aptitude test;
  • provision of cross-border services within the meaning of Article 5(10) of the Act of 22 December 2015 on the rules for the recognition of professional qualifications acquired in the Member States of the European Union and the exercise of cross-border service activities within the meaning of the Act of 6 March 2018 on the rules for the participation of foreign entrepreneurs and other foreign persons in economic transactions on the territory of the Republic of Poland;
  • issuing the European Professional Card referred to in the provisions of Chapter 6 of the Act of 22 December 2015 on the rules for the recognition of professional qualifications acquired in the Member States of the European Union.

b) Help Centre for Entrepreneur;

 c) sending a request by electronic means and obtaining a certificate of solvency:

  • in the payment of contributions for social insurance, health insurance, the Labour Fund and the Guaranteed Employee Benefits Fund;
  • with the implementation of tax obligations incumbent on the entrepreneur.

6. The point is intended primarily for people running or planning to set up a business activity, and therefore for current and future entrepreneurs.

7. The point offers assistance through the functionality of the information and service portal i.e. Help Centre for Entrepreneur.

8. The point operates in close cooperation with public administration bodies providing services in accordance with the jurisdiction, whose duty is to ensure completeness, timeliness, compliance with the applicable law and the comprehensibility and transparency of information made available through the point.
 

II. General information

1. The use of the Point is free of charge.

2. The administrator of the biznes.gov.pl website makes every effort to ensure that the information contained in this website is complete, reliable and up to date.

3. Legal acts published on the Point do not constitute sources of law.

4. The content in the Point is for information purposes only and does not constitute an interpretation of the applicable regulations.

5. The content published in the Point:

  • are solely general and not aimed at individual situations, persons or entities;
  • may refer to external portals, services and databases operated by other bodies and institutions;
  • do not constitute legal advice.

6. Point does not advise on individual cases.

7. The information published in the Point has been prepared by the Minister of Entrepreneurship and Technology or by the competent authorities at their request or with their cooperation.

8. Applications and functionalities enabling the provision of services located in the Point have been developed by the Minister of Entrepreneurship and Technology or by competent authorities at their request or with their cooperation.

9. Information published in foreign languages in the Point may be partially translated with the use of automatic translation of the content of websites, with the reservation that this function does not ensure the full correctness of the translated text.

III. Entrepreneur/Citizen

III.1 Registration

1. This Point may be used by anonymous and registered Users.

2. Anonymous users may use the content of the information published in the Point but have a limited right to access electronic services provided in the Point, which require confirmation of their identity.

3. The user can register only once.

4. By registering, the User is obliged to provide truthful information.

5. You may delete your account at any time. Deleting an account from the system is equivalent to deregistering the User from the Point.

6. Registration of the User consists of two stages:

    a) the registration form must be completed as a first step;

    b) in a second step, you must activate your account using the e-mail address provided during registration.

7. The User provides in the registration form his/her personal data: name, surname, e-mail address and data related to the account, i.e. the password to the created Registration account in the Point, is made by correctly filling in the registration form located on the Point page.

8. The user with an account in the Point receives dedicated e-mail notifications to the e-mail address provided during registration.

9. Registration of the User is also possible through the Trusted Profile using Single Sign-On (SSO) technology. Users logging in to the Point for the first time using the Trusted Profile will be registered in accordance with the data provided by this system and after verification of their e-mail address.

III.2 Online services - handling issues by electronic means

1. Administrative services are provided by filling in and sending appropriate letters by e-mail in accordance with the provisions of the Act of 17 February 2005 on computerisation of activities of entities performing public tasks (Journal of Laws of 2017, item 570).

2. The letters may be signed by the User with the use of a qualified electronic signature or the ePUAP Trusted Profile.

3. Administrative services are provided by filling in an application or other letter at the Point and forwarding it by the Point to the indicated e-mail address of the competent authority's ePUAP mailbox. Step-by-step monitoring of the entire process is carried out via the Point User account.

4. The point shall confirm to the User each time a request/ letter is submitted to the competent authority via the point by delivery of an official document confirming receipt (UPO). The PCA is automatically generated by the competent authority's electronic mailbox ePUAP and provides evidence of an effective submission of the application/written form to the authority. The User shall be notified of delivery to the e-mail address provided during registration. If it is not possible for the Point to deliver the application/written form, the User shall be informed about it to his/her e-mail address provided during registration.  

5. The competent authorities deliver the User's letters via the Point to the unique box address assigned to this User, defined within the electronic mailbox of the Ministry of Enterprise and Technology on the ePUAP platform. The User can read or download the letter at the Point.

6. The User receives the letter delivered via the Point in question in the mode of delivery referred to in Article 46 of the Act of 14 June 1960, Code of Administrative Procedure (Journal of Laws of 2017, item 1257, as amended).

7. Signing by the User of an official certificate of receipt takes place at the Point with the use of a qualified electronic signature or a Trusted Profile.

8. The User shall receive all notifications related to the handling of matters by e-mail to his/her e-mail address provided at the time of registration.

9. If the User deletes his or her account at a Point, it is recommended that the competent authorities are informed about the change of the electronic address to which the authorities deliver letters within the meaning of the provisions of the Code of Administrative Proceedings of 14 June 1960.

10. The services may also be performed by redirecting the User to external IT systems, with the use of which the competent authorities provide services electronically. In such a case, the execution takes place completely outside the Point and the User is not able to track the status of the service at the Point.

III.3 Help Centre - requests for information

1. The point offers assistance through the Help Centre for Entrepreneur, which provides information on, inter alia, matters related to taking up, exercising or termination of business activity in the territory of the Republic of Poland. A User - an entrepreneur or any citizen - registered in the Point may ask a question in an electronic form, to which consultants, experts from competent public administration offices and business support institutions respond.

2. Help Centre biznes.gov.pl is an information point in the field of running business activity, dedicated to entrepreneurs.

3. The Centre provides services to the users of the Central Register and Information on Economic Activity and the Point of biznes.gov.pl. Help Center consultants answer questions through various communication channels, including telephone, livechat, virtual clerk or contact form.

4. Help Center is adapted to support deaf people.

5. Help Center provides information in Polish and English.

6. When using the Help Center, personal data such as your name, surname, company name and e-mail address are provided.

7. The assistance provided by the Centre does not constitute an individual interpretation of the law for the User and is intended to provide general information about the law in force.

III.4 Opinions

1. The Point allows to give opinions on particular information and services by expressing one's assessment and commenting.
2. The Voice of the Entrepreneur is available in the Point and it enables the Users to submit initiatives and proposals concerning, among others, the development of business activity, the rights and obligations of the entrepreneur, financing business activity, introducing innovative products and services to the market, foreign trade, information for entrepreneurs. The purpose of the Voice of the Entrepreneur is to collect comments and opinions concerning simplifications, elimination of barriers and limitations in running business activity and to pass them on to institutions responsible for particular areas.

3. Sending ideas, comments and opinions is not equivalent to submitting applications for improving the functioning of administration within the meaning of the provisions of the Act of 14 June 1960 - Code of Administrative Procedure.

4. The User may post ideas, add comments and opinions to the ideas published in the Voice of the Entrepreneur and vote for the submitted ideas.

5. Entering ideas and comments, as well as voting for selected ideas requires logging in at the Point of biznes.gov.pl. Each logged in User can vote on an idea only once.

6. The information posted by the User in the Entrepreneur's Voice is visible to other users and the Administrator.

7. Ideas should be submitted in accordance with the following principles:

a) the titles of the ideas should reflect the content of the description in a clear and comprehensible manner;

b) the description of the idea should not exceed 1 500 characters;

c) the idea put forward should include a description of the problem and a proposal for its resolution. Claims which do not contain constructive proposals for solutions will not be published;

d) ideas should concern issues related to the conditions for conducting business activity, including the development of business activity, the rights and obligations of the entrepreneur, financing business activity, introducing innovative products and services to the market, foreign trade, information for entrepreneurs and the functioning and content of the Point;

e) before submitting an idea, the User should verify that it has not already been submitted;

f) comments should relate only to ideas submitted: offensive content, that is not in conformity with the label, advertising content that is not related to the subject will not be published;

g) administrators of Voice of Entrepreneur shall not be obliged to join in the discussion on the opinion.

8. The Entrepreneur's Voice Administrator has the right not to publish ideas and comments without giving reasons. The Administrator also reserves the right to: editing, shortening the content of ideas and comments and combining ideas.

9. The user whose idea is published in the Voice of the Entrepreneur shall be notified by e-mail of the publication of the idea or of its rejection. The user is also informed about the change in the status of the idea.

10. User ideas and comments are published under the name of the applicant.

11. The Administrator has the right to block access to the Users who violate the rules specified in point 7(f) of this chapter.

IV. Official

IV.1 Registration

1. Each User may register only once.

2. By registering, each User is obliged to provide information truthfully.

3. The User may at any time de-register from the Point. Deregistering from the Point is the same as deleting the user's account.

4. Registration of the User consists of three stages:

         a) the registration form must be completed as a first step;

         b) the second step is to activate the account using the e-mail address provided during registration;

         c) the Authorisation must be generated and transmitted in the third step

5. The user provides in the registration form his/her personal data: name and surname, e-mail address, data related to the account, i.e. password to access the created account, name of the institution, business position or the name of the department. A representative of the Institution related to the User confirms his/her registration in writing, according to the generated pattern, on the basis of which the User's account will be activated.

6. User Account - the type Official requires confirmation of entitlements on the basis of Authorisation.

7. The authorization is automatically generated on the basis of the data provided by the User in the registration form. Authorisation shall be subject to signature by the person representing the institution.

8. The Authorization Scan shall be attached to your account at the Point and the original shall be sent to the address of the Ministry of Entrepreneurship and Technology.

9. The User who has an account with the Point receives e-mail notification to the email address provided during the registration process.

10. User registration is also possible through a Trusted Profile using Single Sign-On (SSO) technology. Users logging in to the Point for the first time by means of a Trusted Profile will be registered in accordance with the data provided by this system and after verification of their e-mail address.

IV.2 Online services - handling issues by electronic means

1. Services are provided by filling in an application or other letter at the Point and submitting it by the Point to the indicated e-mail address of the ePUAP delivery box of the competent authority.

2. The Point shall each time confirm to the User the submission of an application/letter to the appropriate authority via the Point, by delivery of an official confirmation of receipt (UPO). It is automatically generated by the competent authority's electronic mailbox and provides proof of effective submission of the letter to the competent authority.

3.Sending to the User the appropriate official response from the competent authority is carried out by the Point through the electronic mailbox of the Ministry of Entrepreneurship and Technology on the ePUAP platform. The competent authorities deliver letters to the User via the Point to the unique box address assigned to this User, defined within the electronic mailbox of the Ministry of Entrepreneurship and Technology on the ePUAP platform.

4. Letters and official confirmations of receipt delivered to the User by competent authorities via the Point are available only at the Point. The User receives the letter delivered via the Point in question in the mode of delivery referred to in Article 46 of the Code of Administrative Proceedings of 14 June 1960. Signing an official confirmation of receipt by the User takes place at the Point with the use of a secure electronic signature or a Trusted Profile.

V.3 Help Centre - applications for information

1. Help Centre for entrepreneur of biznes.gov.pl is an information point in the field of running business activity, dedicated to entrepreneurs and administration.

2. The Centre provides services to the users of the Central Business Activity Register and Information as well as the Point. Help Center consultants answer questions through various communication channels, including telephone, livechat, virtual clerk or contact form.

3. The competent authorities at the User Help Centre will also provide answers to your questions.

4. Help Center is adapted to support deaf people.

5. Help Center provides information in Polish and English.

IV.4 Opinions

1. The Point allows to give opinions on particular information and services by expressing one's assessment and commenting.
2. Users with an account of the type of official shall have access to opinions concerning the services and information supervised by their institution. Viewing the opinion is possible through the functionality of the Point described in point IV.5 of this chapter.

3. Sending ideas, comments and opinions is not equivalent to submitting applications for improving the functioning of administration within the meaning of the provisions of the Act of 14 June 1960 - Code of Administrative Procedure.

4. The User may post ideas, add comments and opinions to the ideas published in the Voice of the Entrepreneur and vote for the submitted ideas.

5. Entering ideas and comments, as well as voting for selected ideas requires logging in at the Point of biznes.gov.pl. Each logged in User can vote on an idea only once.

6. The information posted by the User in the Entrepreneur's Voice is visible to other users and the Administrator.

7. It is forbidden to use the Entrepreneur's Voice in a manner contrary to or improper to its purpose. It is forbidden to submit ideas or comments that:

               a) contain words or phrases commonly considered vulgar or offensive, violate generally accepted standards of communication, and                                       discriminate against others on the basis of race, sex, language, religion or lack thereof, social origin, birth, property, or any other reason;

               b) contain advertising content;

               c) refer to political or religious agitation;

               d) incite unethical or illegal conduct;

               e) violate the provisions of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2017, item 880, as amended);

                f) violate the personal rights of others;

                g) promote drugs or violence;

                h) may pose a potential threat to the security of the Republic of Poland;

                i) encourage donations;

                j) contain a link to a user's website for promotional purposes;

                k) contain spam - multiple repetitions of the same content;

                 l) contain content unrelated to the conditions of conducting business activity, development of business activity, rights and obligations of the                            entrepreneur, financing of business activity, introduction of innovative products and services to the market, foreign trade, information for                            entrepreneurs and the functioning and content of the Point.

8. Ideas should be submitted in accordance with the following principles:

IV.6 API

1. The point shall make the collected information available to external information and communication systems via the API. The API allows other systems to use the resources of the Point.

2. API makes public information available in a structured form to, inter alia, BIP portals, regional and industry systems and professional self-government portals.

3. Technical and organisational details concerning access to API are agreed with the Point Administrator.

IV.7 Academy

1. The Academy is a platform enabling employees of public institutions to learn at the address in the domain of biznes.gov.pl.

2. The courses provided by the Academy in the form of multimedia materials support the users of the Point in the most important areas concerning: administrative services, electronic management and the use of the Point's modules, including the Backup.

3. Users can use video guides, training courses, webinars and follow training paths, i.e. structured sets of courses, completed with verification of acquired competences.

V. Protection of personal data

1. The administrator of personal data processed by the Point is the Minister of Entrepreneurship and Technology, Plac Trzech Krzyży 3/5, 00-507 Warsaw, e-mail address: kancelaria.mpit@mpit.gov.pl tel. 22 262 92 46.

2. The Minister of Entrepreneurship and Technology processes personal data on the basis of Article 51, section 1 of the Act of 6 March 2018 on the Central Register and Information on Economic Activity and the Entrepreneur Information Point.

3. Contact details of the Data Protection Officer: e-mail:iod@mpit.gov.pl.

4. Personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (EU Official Journal L No 119, p. 1), hereinafter referred to as the GDPR, and the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2018, item 1000).

5. The Administrator processes personal data of registered Users in order to perform in the territory of the Republic of Poland the tasks of the single point of contact within the meaning of the provision of Article 6 of Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on services on the internal market (Official Journal of the European Union L 376 of 27.12.2006, p. 36), referred to in Chapter III of the Act of 6 March 2018 on the Central Register and Information on Business Activity and the Entrepreneur Information Point.

6. The point shall store and process the documents and personal data of the Users for a period of 10 years from the date of their introduction into the IT system. This period may be longer if the User does not delete the account.

7. In order to maintain an individual user account of the "Entrepreneur/Citizen" type, the Administrator collects the following data in the Point:

a) surname and name;

b) e-mail address;

c) telephone number.

8. In order to maintain an individual user account of the "Official" type, the Administrator collects the following data in a Point:

a) surname and name;

b) e-mail address;

c) the name of the organisation;

d) a department or post;

e) telephone number.

9. Providing personal data by the User is voluntary, but necessary in order to register the User.

10. The data referred to in points (7)(c) and (8)(e) shall be provided by the User on an optional basis.

11. The Administrator collects data of persons who express their willingness to participate in trainings offered by the Academy (name, surname, name of institution, e-mail address, telephone number). This data is used by the administrator for purposes related to the organisation of training courses, including confirmation of participation in training courses. The User of the Point has the right to access his personal data, correct them and limit the processing.

12. If the User believes that the processing of personal data concerning him/her violates the provisions of the GDPR, he/she has the right to lodge a complaint with the President of the Office for Personal Data Protection.

13. The point conducts activities consisting in processing data on the basis of profiling of the User, however, on this basis no decisions are made in individual cases, it does not have any legal effects and does not in any way affect the situation of the User.

14. The Point administrator will make personal data available (to the extent specified in the User's profile) to the authorities responsible for the performance of services launched by the User in the form of a service provided electronically.

VI. System logs and cookies

1. The point collects information contained in system logs (date and time of connection, IP address and others). These data are used for technical, statistical and promotional purposes.

2. The point uses cookies. Cookies are small text files that the web server stores on the User's site. Cookies are used to remember information about User, to create personalised content and to support logging in.

3. The point uses the mechanism of Google Analytics, based on tracking code in JavaScript technology and cookies. This mechanism collects anonymized data about the User's behavior during the session on the website, such as pages displayed and time spent on them, data about the User's device and operating system, and data about the User's interaction with the website (such as clicks on links, downloads of documents).
