The Official Inquiry Form is a part of the polish Point of Single Contact (www.biznes.gov.pl) pled by the Minister of Economy based on provisions in Chapter 2A of the Act on Freedom of Economic Activity from 2nd July 2004.

One of the PSC functions is assuring access to information on:

procedures and formalities for starting, exercising or shutting down businesses within Republic of Poland’s borders;
general service providing rules in countries mentioned by art. 13 par. 1 of the act; especially in terms consumer protection;
contact data of competent authorities along with their field of expertise;
means and condtitions of access to public registers and databases covering economic activity and entrepreneurs;
adequate legal measures applicable for authority/entrepreneur/consumer, entrepreneur/consumer and entrepreneurial disputes;
legal expertise issued or laid down by adequate authorities on starting, exercising or shutting donw businesses;
contact data of associations and/or organisations capable of providing practical assistance for ntrepreneurs and consumers;
employer/employee rights and obligations.

The Point of Single Contact does not provide counsel in individual cases.

PSC Response time is 7 days or 14 days n cases calling for competent authorities to be consulted.

Who can use the service

A nurse or a midwife who has gained qualifications in the EU and wants to practise this profession in Poland for a specified period of time needs to:

submit a declaration to the regional council of nurses and midwives competent for the location where the practice is to be conducted, and submit appropriate documents to certify meeting the requirements indicated in the Act of 15 July 2011 on the professions of nurse and midwife
obtain an entry in the register of citizens of the EU Member States practising the profession of nurse or midwife on a temporary and occasional basis in the territory of a particular chamber

The declaration should be submitted before the start of practising the profession in Poland for the first time, and again each year in which the nurse or the midwife intends to practise the profession in Poland.

What to do step by step

Nurse/midwife - a citizen of the EU who holds a licence to practise the profession in another EU Member State and practising this profession in that State, and who intends to practise this profession in the territory of the Republic of Poland on a temporary and occasional basis, and be entered in the register of citizens of the EU Member States practising the profession of nurse or midwife on a temporary and occasional basis in the territory of a particular chamber, should submit a declaration to the regional chamber of nurses and midwives competent for the location where the practice is to be conducted.

5. A certificate stating that a nurse or a midwife practises the profession in this State legally, and at the time when the certificate has been issued he/she is not subject to any limitation on the practise of the profession, any suspension of the right to practise the profession or a ban from the profession, and that there are no proceedings brought against this person as regards professional liability

6. Declaration confirming the command of the Polish language sufficient to practise a regulated profession

Formal verification

1. The relevant regional council of nurses and midwives (ORPiP) verifies the correctness and completeness of the declaration and the attachments required for the proper conduct of the procedure.

2. If the declaration and its attachments do not meet the formal requirements, the ORPiP requests the applicant to supplement the defects within the indicated time limit (with an instruction that failure to correct these defects will result in the application being left unconsidered).

3. After the formal verification, substantive verification is carried out, during which the ORPiP may contact relevant authorities or organisations of the Member State in which the nurse or the midwife practises the profession of nurse of midwife permanently, to receive information confirming that the nurse of the midwife conducts the activity legally, practises the profession in due manner, and that there have been no disciplinary or criminal sanctions imposed on her/him in relation to the professional practice.

The regional council of nurses and midwives makes an entry in the register of citizens of the European Union Member States practising the profession of nurse or midwife on a temporary and occasional basis in the territory of a particular chamber.
