Dental assistant - provision of cross-border services in Poland

Are you a foreigner - a citizen of the EU, Norway, Iceland, Switzerland or Liechtenstein - and would you like to temporarily provide cross-border services in Poland as a dental assistant? You must first submit a declaration that you intend to provide a cross-border service and, in some cases, also obtain recognition of your qualifications. You will find out how to do this below.

What you should know and who can use this service

Service providers -  nationals of EU Member States, Member States of the European Free Trade Association (EFTA) — parties to the Agreement on the European Economic Area and the entrepreneurs established in a country which has with the European Union and its Member States an agreement governing the freedom to provide services, who exercise the profession of dental assistant in one of the countries concerned, in accordance with the regulations laid by such State, shall have the right to provide a service in the territory of another Member State (in this case the territory of the Republic of Poland) for the purpose of pursuing the same profession.

What to do step by step

  1. Submission of a declaration on the intention of providing cross-border services in the territory of the Republic of Poland

Prior to the provision of cross-border services for the first time in the territory of the Republic of Poland, the service provider shall submit to the Minister of Health a declaration on the intention to provide the cross-border service.  The declaration shall contain information on the type of insurance policy or other means of personal or collective protection with regard to the exercise of a profession of dental assistant in force in the territory of the Republic of Poland. Service provider submits a declaration once again in every year in which he intends to provide cross-border service in the territory of the Republic of Poland.. 

Service provider may deliver  a declaration to the competent authority in person, by another person, by post or by electronic means. 

In addition, in the case of the provision of services for the first time in Poland and in case of a material change in the situation substantiated by the documents, the Minister of Health requires that declaration shall be accompanied by the following documents (on the basis of Article 33 (4) and (5) of the Act of 22 December 2015 on the principles governing the recognition of professional qualifications acquired in Member States of the European Union):

  • a document proving the nationality of the service provider;
  • a certificate confirming that the service provider is legally exercising his profession in the provider's State and is not prohibited (even temporarily) from exercising that profession;
  • documents proving professional qualifications,
  • a document certifying that the regulated profession has been pursued by the provider for at least one year during the previous 10 years, or, in the case of a profession which is not regulated in the provider's State, that he has completed regulated education and training;
  • a certificate that the person concerned has not been convicted of any criminal offences;
  • a statement confirming knowledge of the Polish language to the extent necessary to pursue a regulated profession - in the case of professions with an impact on patient safety.

Conditions for the provision of services:

Cross-border service in a regulated profession may be provided by a service provider who has professional qualifications to exercise a given profession in the country of the service provider, if the profession:

1) is regulated in the service provider's country, or

2) is not regulated in the service provider's country but the service provider:

a) has pursued that profession in at least one Member State for at least one year during the previous 10 years, or

b) has completed regulated education.

Prior to the commencement of service provision for the first time in the territory of the Republic of Poland and again every year in which the service provider intends to provide cross-border service.

  1. Formal and substantive verification of the submitted documents

The Minister of Health shall notify without delay the service provider of the receipt of the declaration and documents.  In the absence of the required documents, the Ministry of Health calls on the service provider to complete them by the deadline specified in the request. 

The Minister of Health attemts to complete the missing information by means of administrative cooperation with the competent authority of the Membe State of the service provide, or, if  the profession is not regulated in the country of service provider, with the assistance centre in the country of the service provider.

Where the applicant supplements documents incompletely or submitted documents contain imprecise records, Minister of Health calls once again for their completion or clarification. 


Minister of Health may ask the competent authorities of the Member State to provide information proving that dental assistant exercises the profession lawfully, properly and that penalties or criminal sanctions have not been related to the pursuit of this profession have not been imposed on him/her.

Where a declaration of the intention to provide cross-border services and the documents submitted are complete or have been improved, the Minister of Health shall give its assessment.  Shall be assessed:

  • subject matter of the service provided,
  • duration of the service provision,
  • frequency of services provision in Poland,
  • regularity of the provision of services,
  • continuity of the provision of services. 

 
In case of correctly submitted set of documents and positive verification of the substance, the applicant may start providing cross-border services in the territory of the Republic of Poland in respect of practising the profession of dental assistant.

  1. Issuance of a decision to recognize qualification or a decision not to recognize professional qualifications of service provider

In the case of the profession of dental assistant, Minister of Health may, where necessary, institute proceedings for recognition of qualifications, if the service provider intends to provide the service in the territory of the Republic of Poland for the first time.  Minister of Health, within one month of receipt of the declaration and accompanying documents, shall issue a decision on the recognition of qualifications or decides not to recognise the professional qualifications of the service provider. Where a decision is not possible within one month from the date of receipt of the declaration, the Minister of Health will inform the service provider within this time limit about the reasons for the delay and the timescale for a decision.  The decision is issued no later than two months from the date of receipt by the Ministry of Health documents referred to in Art. 33 (4)of the Act of 22 December 2015 on the principles governing the recognition of professional qualifications acquired in Member States of the European Union.

The absence of a decision of the Minister of Health within the time limits set out above means that the provider may start providing cross-border services in the territory of the Republic of Poland. 
1.  Where there are substantial differences between the professional qualifications of the service provider and education or training required in the Republic of Poland, having public health or safety implications, and the knowledge, skills or competences acquired through professional experience or confirmed by learning outcomes or confirmed education outcomes cannot offset them, Minister of Health requires the provider to take an aptitude test. and within one month from the imposition of this obligation shall issue a decision on the recognition of qualifications. 

The Ministry of Health, within 3 days of receipt of the declaration, transmits to the Director of the Centre for Examination in Medicine, the following information:

1) list of persons who will take an aptitude test at a given time in the regulated medical profession.

2) information on the differneces in the programme;

3) training programme in the particular regulated medical profession in force in Poland.

The aptitude test is prepared by the Centre of Medical Examinations for each participant and carried out by the State Examinations Board within 3 weeks from the date of the submission of declaration.  

Aptitude test — conduct:

Director of Centre for Examination in Medicine informs the examinee of the fee and the bank account number of the CEM, for which the fee should be transferred.  In the case of persons wishing to provide cross-border services a fee shall be payable within 3 days from the date of receipt of the notification.  The aptitude test shall be conducted within 3 weeks of the date of submission of the  declaration.  The aptitude test consists of a theoretical test or a practical test or theoretical and practical examination.  A theoretical test is conducted in a form of oral exam or in the form of a test.  The form of the aptitude test shall be determined by the Director of CEM after consultation with the President of the Board.  Director of CEM notifies of the place and form of the aptitude test at least 3 days before the date set for the aptitude test.

Where part of the theoretical examination is carried out in the form of a test, it consists of not less than 20 and not more than 50 questions.  The test shall be considered to be successfully passed where examinee scores at least 60 % of the maximum score points.

In the case of oral theoretical examinations it covers at least four examination questions.  Each reply will be assessed separately by each of the members of the board or the examination team.  A response may be assessed negatively if in favour of this assessment will be at least half of the board or the examination team.

If examinee obtains a negative assessment of any of the reply it leads to the negative result of the oral test. 

Practical part of the aptitude test consists of at least four tasks consisting in demonstrating the chosen activities or performance of other tasks proving the acquisition of practical skills necessary to practise a profession of dental assistant in Poland.

The aptitude test shall be considered to be successfully passed if examinee scores positive marks from each part of the aptitude test.

An applicant who has passed the aptitude test, receives from the Director of CEM a certificate, a copy of which transmits to the Ministry of Health.  The certificate shall be issued within 3 days from the date of receipt of the complete examination documentation.

From the conducted aptitude test minutes are drawn up, containing a description of the performance of tasks falling within the scope of practical exam and the results of the aptitude test.  A copy of the minutes from the aptitude test, examination board shall send to the Minister of Health within 3 days of the result. 

In case they do not participate in the aptitude test within the prescribed period or fail the aptitude test, upon written request of an applicant, the Minister of Health shall issue a decision to allow to take an aptitude test as soon as posssible, which is the deadline.

The result of an aptitude test is the basis for recognition by the Minister of Health, whether any differences have been offset by the applicant.

In case of a negative result of an aptitude test, Minister of Health refuses to recognise the professional qualifications of an applicant by means of a decision.  A negative decision on the recognition of qualifications leads to the impossibility of cross-border provision of services by an applicant.

Time limit

Within one month from the date of receipt of the declaration.  In case where issuance of a decision on recognising the qualifications of the service provider, or the decision to withdraw from recognition is not possible within one month from the date of receipt of the declaration, the Minister of Health shall inform the service provider before the expiry of that deadline on the reasons for the delay and then removes them within one month from the date of such communication.  The decision is issued no later than two months from the date of removing the causes of delays (e.g. completion of missing documents).  In case of imposing obligation on the service provider to take an aptitude test, the Minister of Health issues a decision within one month from imposing the obligation.

How much you will have to pay

1053,50 zł

Conduct of the procedure and issuance of a decision on the recognition of professional qualifications to pursue a regulated profession, shall be subject to payment of 35 % of the minimum wage, established on the basis of the Act of 10 October 2002 on the minimum remuneration for work, in force in the year of the initiation of the proceedings.  The fee shall be paid into the bank account of the Ministry of Health. 

In 2018 the minimum wage amounted to PLN 2100,00.

How long you will have to wait

Notification of receipt of the declaration shall be given without delay. Within one month from the date of receiving the declaration together with accompanying documents. In case the issuance of a decision on recognition of the qualifications of the service provider or to withdraw from the recognition of qualifications is not possible within one month from the date of receipt of the declaration, the Minister of Health informs the service provider before the expiry of this deadline about the reasons for the delay, and then removes them within one month from the date of notification. The decision shall be issued no later than within two months from the date of removal of the reasons for the delay (e.g. completion of missing documents). If an obligation is imposed on the service provider to take an aptitude test, the Minister of Health issues a decision within one month from the imposition of the obligation. The lack of a decision within the time limits specified above means that the service provider may start providing cross-border services in the territory of the Republic of Poland.

How can you appeal

Within 14 days from the date of receiving the negative decision, the applicant has the right to submit an application for reconsideration of the matter. After consideration of that application, a decision is issued on revoking the appealed decision in full, in part, or on leaving that decision in force. In case of leaving the decision in force - the applicant may submit a complaint to the Voivodeship Administrative Court in Warsaw through the Ministry of Health.

Good to know

The service provider is obliged to inform the Social Insurance Institution (ZUS) about the provision of a cross-border service before its commencement, and in case of an emergency - after its termination. In practice, this activity consists in obtaining a certificate (on A1 form) on social security cover from the insurer's home institution in his own country. If necessary, the certificate obtained should be presented to a ZUS employee, e. g. in the course of control activities.
