Information on the local job market from the poviat starost

Are you planning to employ a foreign national? Before submitting the application for a work permit, you need to obtain a document from the starost (head of the poviat) confirming that the job cannot be performed by any of the unemployed persons registered in the poviat employment office. Read below to find out more about the procedure.

What you should know and who can use this service

When may you hire a foreign national?

You can employ a foreign national based on a work permit if locally there are no registered unemployed persons who could be employed instead (Polish unemployed persons have the right to be employed first, before foreign nationals).

This will be checked by the poviat employment office. Based on a job market test, it will be verified whether any of the unemployed persons registered at the local employment office is qualified to perform the job you offer. If no one with appropriate qualifications is found, the starost will issue a document confirming that it is not possible to meet your staffing needs on the local job market.

How long will the document on the local job market be valid?

The document from the starost must be issued no earlier than 180 days before submitting the application for a work permit or the application for a seasonal work permit, and in justified reasons approved by the starost - no earlier than 90 days before submitting such application.

Situations when no job market test is required

A job market test is not required in the following cases:

  • the work to be performed by the foreign national is included in the shortage occupation list, as set out in the regulation of the head of voivodship where the foreign national's main place of work is to be located
  • the occupation to be performed by the foreign national is listed in the appendix to the regulation of the Minister of Labour and Social Policy (the list includes for instance doctors, nurses, IT developers, database developers, attendants to elderly persons, bricklayers, house painters, locksmiths, bus drivers)
  • the job offer concerns nursing work or work as a house help, to be performed by nationals of: Armenia, Belarus, Georgia, Moldova, Russia and Ukraine
  • the job concerns work as a sports trainer, athlete, dentist or doctor undergoing a training or completing a specialisation programme,
  • the job offer concerns a foreign national authorised to represent a foreign business entity in that entity’s branch or representation office in Poland
  • the work is to be performed by a foreign national who is a family member of a diplomat or of an employee at a Polish branch of an international organisation, or who works as a member of private home staff for such persons
  • the work is to be performed by a foreign national who is a doctoral student at a Polish higher education institution or who has graduated from a higher education institution in Poland, European Union, Switzerland, Norway, Iceland or Lichtenstein in the last 3 years
  • the work is to be performed by a foreign national who resided in Poland uninterruptedly for 3 years before submitting the application (the stay of a foreign national is considered to be uninterrupted if none of the periods spent outside Poland during such stay is longer than 6 months and all such periods spent outside Poland in total have not exceeded 10 months),
  • the work is to be performed by a citizen of Armenia, Belarus, Georgia, Moldova, Russia and Ukraine, who in the period directly preceding the submission of the application for a work permit was employed for a period no shorter than 3 months with the same employer and on the same position, as specified in a written statement on employment of a foreign national entered in the register of statements - provided such statement on employment of a foreign national entered in the register of statements has been presented, together with an employment contract and documents confirming the payment of social security contributions

Please note! If within the last 6 months the starost has conducted a recruitment procedure for the same position as the one indicated in your job offer, the starost may (but does not have to) issue the information on this basis. This may shorten the waiting time.

This matter may be completed at a poviat employment office.

Submit the job offer to the poviat employment office competent for the main place of work, and indicate that you require information from the starost.

If the foreign national is to work across several poviats, the job offer should be submitted to the poviat employment office competent for your place of residence or for the registered office of your business.

What to do step by step

  1. Submit the job offer and the request for information from the starost

If you are submitting your request online through praca.gov.pl, select the tab "Zgłoszenie oferty pracy PSZ-ZOPP" (Job offer notification) and complete the form online (in Polish). Indicate that you wish to obtain the information from the starost.

  1. The office will check the register of unemployed persons

The office will check whether the register of the unemployed and jobseekers includes any persons qualified to perform the job you offer.

  1. The starost will issue the document on the possibility to meet the staffing needs

Having analysed the register of the unemployed, the starost will inform you whether anyone from the register is qualified to perform the job you offer.

If such persons are found in the register but you do not agree to have them referred to work for you or to employ them - the starost will issue a document confirming that it is possible to meet your staffing needs locally. With this answer to your request, you will not be able to hire a foreign national.

If no suitable job candidates are found in the register - the starost will issue a document confirming that it is not possible to meet the staffing needs locally. Based on this document, you will be able to apply to the head of the voivodeship for a work permit, indicating specific foreign nationals to be employed by you. The document from the starost needs to be attached to the application for a work permit for a foreign national, an application for a temporary residence permit for the purpose of work, or for a temporary residence permit for the purpose of work as a highly qualified professional.

The office will issue the document for you: no later than within 14 days from the date of submission of the job offer in the employment office - if the analysis of the register of the unemployed and jobseekers does not show that such registered persons are qualified for the job you offer no later than 21 days from the date of submission of the job offer - if an unemployed person registered in the office is found to be qualified for the job you offer
