Inland navigation sailor - recognition of qualifications Are you a citizen of a member state of the European Union, or Norway, Iceland, Liechtenstein or Switzerland? Do you have qualifications for a regulated profession and want to practice this profession in Poland? Read the description of the service and apply for recognition of your qualifications. How to proceed This procedure can be completed: at an office by post electronically Complete the procedure online Complete the service online, you will need a Trusted Profile or a qualified signature What you should know and who can use this service Regulated profession Your profession is a regulated profession when you can only practise it once you have met certain requirements (e.g. passing an exam or obtaining entry on a list). Each country determines whether a profession will be considered to be regulated in its country. If the profession is not a regulated profession, the decision to employ a person with qualifications acquired outside Poland is made by the employer. Who can apply for recognition of qualifications Anyone who wants to work in a country where the profession is regulated (e.g. Poland) can apply for official recognition of their qualifications obtained in the EU (education and professional experience). This will enable him/her to work in his/her profession. In addition, for recognition of qualifications may apply: family members of Polish citizens or nationals of Member States of the European Union, Switzerland or Norway, Iceland, Liechtenstein; third-country nationals with long-term resident status of the European Union; foreigners with refugee status or subsidiary protection; foreigners arriving in the territory of the Republic of Poland or staying in this territory for the purpose of reunification with their family members who are members of a foreigner's family residing on the territory of the Republic of Poland in connection with granting him/her refugee status or subsidiary protection; third-country nationals who apply to be admitted to the territory of the Republic of Poland for highly qualified professions; third-country nationals who have been admitted to the territory of the Republic of Poland for purposes other than work in accordance with European Union or national law, who have the right to work and who hold a residence permit in accordance with Council Regulation (EC) No 1030/2002 and a third-country national admitted to the territory of the Republic of Poland in order to perform work in accordance with European Union or national law, who have the right to work and who hold a residence permit in accordance with Council Regulation (EC) No 1030/2002 and a third-country national admitted to the territory of the Republic of Poland in order to perform work in accordance with European Union or national law; third-country nationals holding a temporary residence permit for the purpose of carrying out scientific research. Note! The description of the service has been prepared on the basis of basic legal acts, including the Act of 22 December 2015 on the principles of recognition of professional qualifications acquired in the Member States of the European Union. When you should complete this procedure At any time Where you can complete this procedure The application and attachments shall be submitted to the director of the inland waterway authority in whose territory the pursuit of the profession is planned. The scope of activity of individual directors of inland navigation offices is specified in the Regulation of the Minister of the maritime economy and the inland waterway shipping from 24 September 2018 on the territorial scope of action of directors of offices of the inland waterway shipping of both registered offices of their offices and registered offices and the local property of branch offices of these offices What to do step by step Submit an application for recognition of qualifications to pursue a regulated profession The application shall be accompanied by documents confirming qualifications (e.g. education, professional experience), prepared in Polish or together with a copy of the translation into Polish. If you do not have a place of residence or habitual residence or registered office in the Republic of Poland or another Member State of the European Union, you do not have an attorney-in-fact residing in Poland or you do not act through the consul of the Republic of Poland, then you must indicate in Poland an attorney for service. You do not have to appoint an attorney-in-fact if you decide to settle the matter online. The office will notify you within one month that it has received your application. How much you will have to pay 980 zł The fee shall be paid into the bank account of the competent office. Documents 1. Proof of payment of the fee You can submit a document as: Oryginał, Uwierzytelniona kopia The office will check your documents If the office finds that there are deficiencies, it will call on you to rectify them within a specific deadline. If you do not provide the missing documents, your application will not be considered further. The office will also check whether your qualifications obtained abroad are suitable for practising a regulated profession in Poland. In justified cases, the office may request additional information from the EU Member State in which the document confirming the qualifications was issued or from a support centre operating in a Member State. You can receive a decision that you need to have an adaptation period or take an aptitude test. On the basis of documents the official shall state that: a) you have appropriate qualifications for recognition of professional qualifications or b) you do not have appropriate qualifications for recognition of professional qualifications or c) you must serve an adaptation period or take an aptitude test if your qualifications are not complete. Note! If you have a first level professional qualification (see Article 18(6) of the Act) and the regulated profession requires a fourth level professional qualification (see Article 18(3) of the Act), the authority may require you to complete both an adaptation period and an aptitude test. Provide information that you choose an adaptation period or an aptitude test (if you need to complete your qualifications). After the office receives your answer, you will be referred for an adaptation period or receive a notification of the aptitude test date. Take an adaptation period or a test (if you need to complete your qualifications) The rules for the adaptation period and the aptitude test are laid down in individual regulations. You bear the costs of an adaptation internship or taking an aptitude test. The opinion of the adaptation period supervisor and the result of the test are the basis for the office to establish the equalisation of differences and issue a decision on the recognition of qualifications. How much you will have to pay 980 zł The level of fees for the aptitude test and adaptation period is regulated by the provisions of specific implementing acts. Time limit The maximum duration of the adaptation period is 3 years. However, you can take the test no later than 6 months from the date on which this obligation was imposed on you. You will receive a decision on recognition of qualifications or a negative decision. If your qualifications for a regulated profession are recognised, you can use the title established for the regulated profession in Poland or its abbreviation. If the use of the title established for a regulated profession in Poland depends on membership in a professional organisation or on the decision of a competent authority, you have the right to use this title or its abbreviation after obtaining membership in the organisation or after obtaining a decision of a body, respectively. Documents 1. Decision on recognition of qualification to pursue a regulated profession You will receive a document as: Oryginał How much you will have to pay The service is chargeable, details can be found in the description of steps. How long you will have to wait You will receive your decision within 3 months from when you submit all the required documents. This period may be extended by one month in special cases, which will be notified to you by the official. If it turns out that you have to take an aptitude test, the deadline for issuing the decision will be suspended until the day on which the office receives an assessment of your adaptation period or the result of your aptitude test. How can you appeal If you receive a negative decision, you have 14 days to apply for a re-examination of the case. Once your application has been considered, the authority will either overturn the contested decision in whole or in part, or uphold the decision. If the decision is upheld, you can lodge a complaint against the decision with the competent Voivodeship Administrative Court through the office that issued the decision. If the decision on the recognition of qualifications to practise a regulated profession has been issued by a professional self-government body, the appeal shall be filed in accordance with the rules laid down in the detailed provisions applicable to the professional self-government concerned Good to know A person whose professional qualifications for a regulated profession are subject to recognition must speak Polish to the extent necessary for the exercise of that profession. Verification of knowledge of the Polish language may take place after issuing a decision on the recognition of qualifications, in the case of persons exercising: 1) professions with an impact on patient safety; 2) other professions - if there is a justified doubt as to sufficient knowledge of the Polish language to exercise a regulated profession. Verification of the knowledge of the Polish language takes place at your request and is payable. The amount of the fee is determined by the unit carrying out the verification.
