Declaration on the posting of a worker to the territory of Poland

You are a foreign employer and you post workers to Poland? Notify the National Labour Inspectorate (Państwowa Inspekcja Pracy) of this fact. Below you will find information on how and when to do that.

What you should know and who can use this service

If you are a foreign employer who posts a worker to the territory of Poland:

  • to perform a contract concluded with an entity established in the territory of Poland, or
  • to a branch or an undertaking owned by a group of undertakings established in the territory of Poland, or
  • as a temporary employment agency or a placement agency posting the worker to a user undertaking in Poland

- you are required to submit a declaration on the posting of a worker to the National Labour Inspectorate.

If a foreign temporary employment undertaking or placement agency has hired out a temporary agency worker to a user undertaking in the same or another Member State and that user undertaking performs services for a Polish contractor using workers previously hired out to him from such an agency, this foreign agency is also required to submit a declaration on the posting of a worker to the territory of Poland. In such a case, the temporary employment undertaking or placement agency is regarded as an employer posting a worker to the territory of Poland!

Please note! In order for the agency to fulfil the obligation to submit the declaration on posting, the user undertaking must notify it of the intention to hire out the temporary agency worker to Poland 15 working days before the planned posting at the latest.

What to do step by step

  1. Submit the declaration on the posting of a worker to the territory of Poland

The easiest way is to submit the declaration by electronic means: select the ‘Send online’ button to do this. Please remember that you do not need to print, sign by hand or scan declaration forms. It is enough to complete the declaration form on a computer and confirm it by a qualified signature or a Trusted Profile.

Please note! Do not send the declaration by email, as the National Labour Inspectorate will not accept it in this form.

You may also submit the declaration in paper form. Use the model forms made available on the website in question for this purpose.

You will not receive any acknowledgement of receipt from the office, as it does not issue such acknowledgements.

Good to know

If you do not submit the declaration to the National Labour Inspectorate on the day on which the posted worker begins work in Poland at the latest, you will be liable to a fine of PLN 1 000 to PLN 30 000.
