What you should know and who can use this service
As a foreign employer temporarily posting a worker to Poland, you are required to notify the National Labour Inspectorate of any changes in the data contained in the declaration on the posting of the worker to the territory of Poland. The following data may be changed, in particular:
- the name of the employer posting the worker,
- the registered office (address) and the company telephone number and email address; and the place of residence (address) and the company telephone number and email address for an employer who is a natural person,
- the Tax Identification Number NIP or the identification number assigned in the Member State of establishment for tax or insurance purposes,
- the details of the person designated as responsible for contacts with the National Labour Inspectorate (or if you are an employer from a non-EU country, the details of the person acting on your behalf and authorised to represent you before the National Labour Inspectorate), covering that person’s full name, the address of the place of stay, and the company telephone number and email address,
- the place were documents on the posted workers are kept,
- the details of the workers posted to Poland,
- the place where the workers work in the territory of Poland,
- the end date of the posting period earlier than previously indicated in the declaration.
If a worker has been hired out to a user undertaking in Poland by a temporary employment undertaking or placement agency, the agency is required to provide information on changes in that user undertaking’s details if the temporary agency worker is hired out to another user undertaking in Poland.
Foreign employment undertakings or placement agencies are also required to submit notifications of changes in data. This obligation arises if such an agency hired out a worker to a user undertaking in the same or different Member State and the user undertaking hired that person to Poland, as a result of which the foreign agency was required to submit the declaration on the posting of the worker to the territory of Poland, and then the information contained in this declaration has changed in some way (e.g. the place where such a worker works in Poland has changed).
When you should complete this procedure
The notification of changes in the data should be submitted within 7 working days from the date of the changes.
